Senator Altman moved the following:

4 Delete lines 264 - 300
5 and insert:
6 (d) If a traffic citation is issued under s. 316.0083 and
7 the violation occurred in the unincorporated portion of a county
8 which has divided the function of clerk between the clerk of the
9 circuit court and the county comptroller who serves as ex
10 officio clerk of the board of county commissioners, recorder,
11 auditor, and custodian of all county funds and official records,
12 the traffic infraction officer shall provide a replica of the
13 citation to the county comptroller within 5 days after the date
14 of issuance of the citation to the violator.
15 Section 8. Subsection (2) of section 318.14, Florida
16 Statutes, is amended to read:
17 318.14 Noncriminal traffic infractions; exception;
18 procedures.—
19 (2) Except as provided in s. 316.1001(2) and s.
20 316.0083(3), any person cited for an infraction under this
21 section must sign and accept a citation indicating a promise to
22 appear. The officer may indicate on the traffic citation the
23 time and location of the scheduled hearing and must indicate the
24 applicable civil penalty established in s. 318.18.
25 Section 9. Subsection (15) of section 318.18, Florida
26 Statutes, is amended to read:
27 318.18 Amount of penalties.—The penalties required for a
28 noncriminal disposition pursuant to s. 318.14 or a criminal
29 offense listed in s. 318.17 are as follows:
30 (15)(a) One hundred fifty twenty-five dollars for a
31 violation of s. 316.074(1) or s. 316.075(1)(c)1. when a driver
32 has failed to stop at a traffic signal and when enforced by a
33 law enforcement officer. Sixty dollars shall be distributed as
34 provided in s. 318.21, $25 shall be distributed to the General
35 Revenue Fund, and the remaining $65 shall be remitted to the
36 Department of Revenue for deposit into the Administrative Trust
37 Fund of the Department of Health.
38 (b) One hundred fifty dollars for a violation of s.
39 316.074(1) or s. 316.075(1)(c)1. when a driver has failed to
40 stop at a traffic signal and when enforced by the department’s
41 traffic infraction enforcement officer shall be distributed to
42 the General Revenue Fund.
43 (c) One hundred fifty dollars for a violation of s.
44 316.074(1) or s. 316.075(1)(c)1. when a driver has failed to
45 stop at a traffic signal and when enforced by a county or
46 municipality’s traffic infraction enforcement officer. Eighty
47 five dollars shall be distributed to the county or municipality
48 issuing the citation, $40 shall be distributed to the General
49 Revenue Fund, and the remaining $25 shall be remitted to the
50 Department of Revenue for deposit into the Department of Health
51 Administrative Trust Fund.
