A bill to be entitled
2An act relating to spousal and child support; amending s.
361.13, F.S.; providing requirements for child support and
4income deduction orders relating to termination of child
5support; amending s. 61.14, F.S.; specifying how payments
6on alimony or spousal support judgments shall be applied;
7providing for enforcement of interest payments on child
8support and alimony or spousal support judgments;
9providing that interest not accrue on postjudgment
10interest; amending s. 61.30, F.S.; specifying a definition
11relating to payment of child support varying from the
12guideline amount whenever any of the children are required
13by court order to spend a substantial amount of time with
14either parent; requiring specified findings in order for a
15court to impute income beyond minimum wage; prohibiting
16use of certain factors in imputing income beyond minimum
17wage unless a court makes specified findings; revising
18provisions relating to income tax calculations used in
19determining net income; deleting certain net income
20amounts from the child support guidelines schedule;
21providing that certain percentages used for combined
22monthly net income greater than the amount set out in the
23guidelines schedule shall not be used to determine child
24support beyond the amount necessary to satisfy the
25reasonable needs of the child or children; eliminating a
26reduction in the child care cost added to the basic
27support obligation; providing for determination of the
28total minimum child support need; providing for payment of
29a parent's share of the minimum total child support need;
30deleting provisions relating to adjustment of a minimum
31child support award relating to the Internal Revenue
32Service dependency exemption; providing for adjustment of
33a party's minimum child support award when application of
34the child support guidelines leaves the party with a net
35income lower than the federal poverty guidelines; allowing
36a court to order a party to execute a waiver of the
37Internal Revenue Service dependency exemption for a child
38for good cause shown; amending s. 409.2563, F.S.; revising
39provisions relating to a presumption of minimum wage
40earning capacity for purposes of administrative support
41orders; amending s. 742.08, F.S.; providing for
42enforcement of interest payments on support judgments;
43providing that interest shall not accrue on postjudgment
44interest; providing an effective date.

46Be It Enacted by the Legislature of the State of Florida:
47
48     Section 1.  Paragraph (a) of subsection (1) of section
4961.13, Florida Statutes, is amended to read:
50     61.13  Support of children; parenting and time-sharing;
51powers of court.--
52     (1)(a)  In a proceeding under this chapter, the court may
53at any time order either or both parents who owe a duty of
54support to a child to pay support to the other parent or, in the
55case of both parents, to the person with custody in accordance
56with the child support guidelines schedule in s. 61.30.
57     1.  All child support orders and income deduction orders
58entered on or after October 1, 2009, shall provide for the
59following:
60     a.  Termination of child support upon a child's 18th
61birthday, unless the court finds or has previously found that s.
62743.07(2) applies or unless otherwise agreed to by the parties.
63     b.  A schedule, based upon the record existing at the time
64of the order, stating the amount of the monthly child support
65obligation for all the minor children at the time of the order
66and the amount of child support that will be owed for the
67remaining children for whom child support will continue when any
68child is no longer entitled to receive child support under this
69subparagraph.
70     c.  The month and year that the reduction or termination of
71child support becomes effective.
72     2.  Notwithstanding subparagraph 1., the court initially
73entering an order requiring one or both parents to make child
74support payments has continuing jurisdiction after the entry of
75the initial order to modify the amount and terms and conditions
76of the child support payments when the modification is found
77necessary by the court in the best interests of the child, when
78the child reaches majority, when there is a substantial change
79in the circumstances of the parties, when s. 743.07(2) applies,
80or when a child is emancipated, marries, joins the armed
81services, or dies. The court initially entering a child support
82order has continuing jurisdiction to require the obligee to
83report to the court on terms prescribed by the court regarding
84the disposition of the child support payments.
85     Section 2.  Paragraph (d) of subsection (6) of section
8661.14, Florida Statutes, is amended, and subsection (12) is
87added to that section, to read:
88     61.14  Enforcement and modification of support,
89maintenance, or alimony agreements or orders.--
90     (6)
91     (d)  The court shall hear the obligor's motion to contest
92the impending judgment within 15 days after the date of filing
93of the motion. Upon the court's denial of the obligor's motion,
94the amount of the delinquency and all other amounts that become
95due, together with costs and a service charge of up to $25,
96become a final judgment by operation of law against the obligor.
97The depository shall charge interest at the rate established in
98s. 55.03 on all judgments for support. Payments on judgments
99shall be applied first to the current child support due, then to
100any delinquent principal, and then to interest on the support
101judgment. Payments on alimony or spousal support judgments shall
102be applied first to the current alimony or spousal support due,
103then to any delinquent principal, and then to interest on the
104alimony or spousal support judgment.
105     (12)  Interest on child support and alimony or spousal
106support judgments shall be enforceable through all of the
107methods available to enforce the underlying support order,
108including contempt. Interest shall not accrue on postjudgment
109interest.
110     Section 3.  Paragraph (a) of subsection (1), paragraph (b)
111of subsection (2), paragraph (a) of subsection (3), and
112subsections (6), (7), (10), and (11) of section 61.30, Florida
113Statutes, are amended, and subsection (18) is added to that
114section, to read:
115     61.30  Child support guidelines; retroactive child
116support.--
117     (1)(a)  The child support guideline amount as determined by
118this section presumptively establishes the amount the trier of
119fact shall order as child support in an initial proceeding for
120such support or in a proceeding for modification of an existing
121order for such support, whether the proceeding arises under this
122or another chapter. The trier of fact may order payment of child
123support which varies, plus or minus 5 percent, from the
124guideline amount, after considering all relevant factors,
125including the needs of the child or children, age, station in
126life, standard of living, and the financial status and ability
127of each parent. The trier of fact may order payment of child
128support in an amount which varies more than 5 percent from such
129guideline amount only upon a written finding explaining why
130ordering payment of such guideline amount would be unjust or
131inappropriate. Notwithstanding the variance limitations of this
132section, the trier of fact shall order payment of child support
133which varies from the guideline amount as provided in paragraph
134(11)(b) whenever any of the children are required by court order
135or mediation agreement to spend a substantial amount of time
136with either parent as defined by subparagraph (11)(b)8. This
137requirement applies to any living arrangement, whether temporary
138or permanent.
139     (2)  Income shall be determined on a monthly basis for each
140parent as follows:
141
142     (b)1.  Income on a monthly basis shall be imputed to an
143unemployed or underemployed parent when such employment or
144underemployment is found by the court to be voluntary on that
145parent's part, absent a finding of fact by the court of physical
146or mental incapacity or other circumstances over which the
147parent has no control. In the event of such voluntary
148unemployment or underemployment, the employment potential and
149probable earnings level of the parent shall be determined based
150upon his or her recent work history, occupational
151qualifications, and prevailing earnings level in the community
152as provided in this paragraph; however, the court may refuse to
153impute income to a parent if the court finds it necessary for
154the parent to stay home with the child who is the subject of a
155child support calculation.
156     2.  In order for the court to impute income beyond minimum
157wage under subparagraph 1., the court must make specific
158findings of fact consistent with the requirements of this
159subparagraph. The party seeking to impute income has the burden
160to present competent, substantial evidence showing the
161following:
162     a.  That the unemployment or underemployment is voluntary.
163     b.  The amount and source of the imputed income, through
164evidence of income from available employment for which the party
165is suitably qualified by education, experience, current
166licensure, or geographic location, with due consideration being
167given to the parties' time-sharing schedule and their historical
168exercise of the time-sharing provided in the parenting plan or
169relevant order.
170     3.   There shall be a rebuttable presumption entitling the
171court to impute Florida minimum wage on a full-time basis to a
172parent, absent a finding by the court that:
173     a.  The parent has a physical or mental incapacity that
174renders the parent unemployable or underemployed;
175     b.  The parent needs to stay home to care for a child who
176is the subject of the child support calculation, thereby
177preventing the parent's employment or rendering the parent
178underemployed; or
179     c.  There are other circumstances over which the parent has
180no control, except for penal incarceration, that prevent the
181parent from earning an income.

183If evidence is produced that demonstrates that the parent is a
184resident of another state, that state's minimum wage law shall
185apply. In the absence of a state minimum wage, the federal
186minimum wage as determined by the United States Department of
187Labor shall apply.
188     4.  Unless the court makes the appropriate findings under
189sub-subparagraph 2.b., income may not be imputed beyond minimum
190wage requirements in subparagraph 3. based upon:
191     a.  Income records that are more than 5 years old at the
192time of the hearing or trial at which imputation is sought; or
193     b.  Income at a level that a party has never earned in the
194past, unless recently degreed, licensed, certified, relicensed,
195or recertified and thus qualified for, subject to geographic
196location, with due consideration of the parties' existing time-
197sharing schedule and their historical exercise of the time-
198sharing provided in the parenting plan or relevant order.
199     (3)  Net income is obtained by subtracting allowable
200deductions from gross income. Allowable deductions shall
201include:
202     (a)  Federal, state, and local income tax, which shall be
203calculated using gross income deductions, adjusted for actual
204filing status, personal and dependency exemptions, applicable
205deductions, earned income credits, child and dependent care
206credits, and other allowable tax credits and allowable
207dependents and income tax liabilities.
208     (6)  The following guidelines schedule shall be applied to
209the combined net income to determine the minimum child support
210need:

403For combined monthly net income less than the amount set out on
404the above guidelines schedule, the parent should be ordered to
405pay a child support amount, determined on a case-by-case basis,
406to establish the principle of payment and lay the basis for
407increased orders should the parent's income increase in the
408future. For combined monthly net income greater than the amount
409set out in the above guidelines schedule, the obligation shall
410be the minimum amount of support provided by the guidelines
411schedule plus the following percentages multiplied by the amount
412of income over $10,000:

417These percentages shall not be used to determine child support
418beyond the amount necessary to satisfy the reasonable needs of
419the child or children.
420     (7)  Child care costs incurred on behalf of the children
421due to employment, job search, or education calculated to result
422in employment or to enhance income of current employment of
423either parent shall be reduced by 25 percent and then shall be
424added to the basic obligation. After the adjusted child care
425costs are added to the basic obligation, any moneys prepaid by a
426parent for child care costs for the child or children of this
427action shall be deducted from that parent's child support
428obligation for that child or those children. Child care costs
429shall not exceed the level required to provide quality care from
430a licensed source for the children.
431     (10)  The total minimum child support need shall be
432determined by adding child care costs and health insurance costs
433to the minimum child support need. Each parent's actual dollar
434share of the total minimum child support need shall be
435determined by multiplying the minimum child support need by each
436parent's percentage share of the combined monthly net income.
437The resulting amount shall be paid by the parent having less
438than 40 percent of the overnight time-sharing to the parent
439having more than 60 percent of the overnight time-sharing.
440     (11)(a)  The court may adjust the total minimum child
441support award, or either or both parents' share of the total
442minimum child support award, based upon the following deviation
443factors:
444     1.  Extraordinary medical, psychological, educational, or
445dental expenses.
446     2.  Independent income of the child, not to include moneys
447received by a child from supplemental security income.
448     3.  The payment of support for a parent which regularly has
449been paid and for which there is a demonstrated need.
450     4.  Seasonal variations in one or both parents' incomes or
451expenses.
452     5.  The age of the child, taking into account the greater
453needs of older children.
454     6.  Special needs, such as costs that may be associated
455with the disability of a child, that have traditionally been met
456within the family budget even though the fulfilling of those
457needs will cause the support to exceed the presumptive amount
458established by the guidelines.
459     7.  Total available assets of the obligee, obligor, and the
460child.
461     8.  The impact of the Internal Revenue Service dependency
462exemption and waiver of that exemption. The court may order a
463parent to execute a waiver of the Internal Revenue Service
464dependency exemption if the paying parent is current in support
465payments.
466     8.9.  When application of the child support guidelines
467schedule requires a person to pay another person more than 55
468percent of his or her gross income for a child support
469obligation for current support resulting from a single support
470order or when the application of the child support guidelines
471leaves a party with a net income that is lower than the current
472federal poverty guidelines.
473     9.10.  The particular parenting plan, such as where the
474child spends a significant amount of time, but less than 40
475percent of the overnights, with one parent, thereby reducing the
476financial expenditures incurred by the other parent; or the
477refusal of a parent to become involved in the activities of the
478child.
479     10.11.  Any other adjustment which is needed to achieve an
480equitable result which may include, but not be limited to, a
481reasonable and necessary existing expense or debt. Such expense
482or debt may include, but is not limited to, a reasonable and
483necessary expense or debt which the parties jointly incurred
484during the marriage.
485     (b)  Whenever a particular parenting plan provides that
486each child spend a substantial amount of time with each parent,
487the court shall adjust any award of child support, as follows:
488     1.  In accordance with subsections (9) and (10), calculate
489the amount of support obligation apportioned to each parent
490without including day care and health insurance costs in the
491calculation and multiply the amount by 1.5.
492     2.  Calculate the percentage of overnight stays the child
493spends with each parent.
494     3.  Multiply each parent's support obligation as calculated
495in subparagraph 1. by the percentage of the other parent's
496overnight stays with the child as calculated in subparagraph 2.
497     4.  The difference between the amounts calculated in
498subparagraph 3. shall be the monetary transfer necessary between
499the parents for the care of the child, subject to an adjustment
500for day care and health insurance expenses.
501     5.  Pursuant to subsections (7) and (8), calculate the net
502amounts owed by each parent for the expenses incurred for day
503care and health insurance coverage for the child. Day care shall
504be calculated without regard to the 25-percent reduction applied
505by subsection (7).
506     6.  Adjust the support obligation owed by each parent
507pursuant to subparagraph 4. by crediting or debiting the amount
508calculated in subparagraph 5. This amount represents the child
509support which must be exchanged between the parents.
510     7.  The court may deviate from the child support amount
511calculated pursuant to subparagraph 6. based upon the deviation
512factors in paragraph (a), as well as the obligee parent's low
513income and ability to maintain the basic necessities of the home
514for the child, the likelihood that either parent will actually
515exercise the time-sharing schedule set forth in the parenting
516plan granted by the court, and whether all of the children are
517exercising the same time-sharing schedule.
518     8.  For purposes of adjusting any award of child support
519under this paragraph, "substantial amount of time" means that a
520parent exercises time-sharing visitation at least 40 percent of
521the overnights of the year.
522     (c)  A parent's failure to regularly exercise the court-
523ordered or agreed time-sharing schedule not caused by the other
524parent which resulted in the adjustment of the amount of child
525support pursuant to subparagraph (a)9.10. or paragraph (b) shall
526be deemed a substantial change of circumstances for purposes of
527modifying the child support award. A modification pursuant to
528this paragraph shall be retroactive to the date the noncustodial
529parent first failed to regularly exercise the court-ordered or
530agreed time-sharing schedule.
531     (18)  The court may, for good cause shown, order the parent
532otherwise entitled to the Internal Revenue Service dependency
533exemption for a child to execute a waiver of the dependency
534exemption.
535     Section 4.  Paragraph (a) of subsection (5) of section
536409.2563, Florida Statutes, is amended to read:
537     409.2563  Administrative establishment of child support
538obligations.--
539     (5)  PROPOSED ADMINISTRATIVE SUPPORT ORDER.--
540     (a)  After serving notice upon a parent in accordance with
541subsection (4), the department shall calculate that parent's
542child support obligation under the child support guidelines
543schedule as provided by s. 61.30, based on any timely financial
544affidavits received and other information available to the
545department. If either parent fails to comply with the
546requirement to furnish a financial affidavit, the department may
547proceed on the basis of information available from any source,
548if such information is sufficiently reliable and detailed to
549allow calculation of guideline schedule amounts under s. 61.30.
550If a parent receives public assistance and fails to submit a
551financial affidavit, the department may submit a financial
552affidavit for that parent pursuant to s. 61.30(15). If there is
553a lack of sufficient reliable information concerning a parent's
554actual earnings for a current or past period, there shall be a
555rebuttable presumption it shall be presumed for the purpose of
556establishing a support obligation that the parent had an earning
557capacity equal to the Florida federal minimum wage on a full-
558time basis during the applicable period, unless evidence is
559presented that the parent is a resident of another state, in
560which case that state's minimum wage shall apply. In the absence
561of a state minimum wage, the federal minimum wage as determined
562by the United States Department of Labor shall apply.
563     Section 5.  Section 742.08, Florida Statutes, is amended to
564read:
565     742.08  Default of support payments.--Upon default in
566payment of any moneys ordered by the court to be paid, the court
567may enter a judgment for the amount in default, plus interest,
568administrative costs, filing fees, and other expenses incurred
569by the clerk of the circuit court which shall be a lien upon all
570property of the defendant both real and personal. Interest on
571support judgments shall be enforceable through all of the
572methods available to enforce the underlying support order,
573including contempt. Interest shall not accrue on postjudgment
574interest. Costs and fees shall be assessed only after the court
575makes a determination of the nonprevailing party's ability to
576pay such costs and fees. In Title IV-D cases, any costs,
577including filing fees, recording fees, mediation costs, service
578of process fees, and other expenses incurred by the clerk of the
579circuit court, shall be assessed only against the nonprevailing
580obligor after the court makes a determination of the
581nonprevailing obligor's ability to pay such costs and fees. The
582Department of Revenue shall not be considered a party for
583purposes of this section; however, fees may be assessed against
584the department pursuant to s. 57.105(1). Willful failure to
585comply with an order of the court shall be deemed a contempt of
586the court entering the order and shall be punished as such. The
587court may require bond of the defendant for the faithful
588performance of his or her obligation under the order of the
589court in such amount and upon such conditions as the court shall
590direct.
591     Section 6.  This act shall take effect October 1, 2009.
