The Committee on Community Affairs (Wise) recommended the
following:

4 insert:
5 Section 1. Paragraph (f) of subsection (1) of section
6 538.03, Florida Statutes, is amended to read:
7 538.03 Definitions; applicability.—
8 (1) As used in this part, the term:
9 (f) “Secondhand goods” means personal property previously
10 owned or used, which is not regulated metals property regulated
11 under part II and which is purchased, consigned, or traded as
12 used property. Such secondhand goods do not include office
13 furniture, pianos, books, clothing, organs, coins, motor
14 vehicles, costume jewelry, exercise equipment, and secondhand
15 sports equipment that is not permanently labeled with a serial
16 number. For purposes of this paragraph, “secondhand sports
17 equipment” does not include golf clubs.

20 And the title is amended as follows:
21 Delete everything before the enacting clause
22 and insert:
23 An act relating to secondhand dealers and secondary metals
24 recyclers; amending s. 538.03, F.S.; excluding exercise
25 equipment from the definition of secondhand goods; creating s.
26 538.27, F.S.; prohibiting a political subdivision of the state
27 or a municipality from adopting or enforcing any local
28 ordinance, special law, or local regulation governing secondary
29 metals recyclers which is more stringent or restrictive than the
30 provisions of part II of ch. 538, F.S.; providing an effective
31 date.
