| 10 | Be It Enacted by the Legislature of the State of Florida: |
| 11 |
|
| 12 | Section 1. This act may be cited as the "Erik Jersted |
| 13 | Memorial Act." |
| 14 | Section 2. Paragraphs (qqq) and (rrr) are added to |
| 15 | subsection (4) of section 320.08056, Florida Statutes, to read: |
| 16 | 320.08056 Specialty license plates.-- |
| 17 | (4) The following license plate annual use fees shall be |
| 18 | collected for the appropriate specialty license plates: |
| 19 | (qqq) Let's Go Surfing license plate, $25. |
| 20 | (rrr) Florida Horse Park license plate, $25. |
| 21 | Section 3. Subsections (69) and (70) are added to section |
| 22 | 320.08058, Florida Statutes, to read: |
| 23 | 320.08058 Specialty license plates.-- |
| 24 | (69) LET'S GO SURFING LICENSE PLATES.-- |
| 25 | (a) The department shall develop a Let's Go Surfing |
| 26 | license plate as provided in this section. Let's Go Surfing |
| 27 | license plates must bear the colors and design approved by the |
| 28 | department. The word "Florida" must appear at the top of the |
| 29 | plate, and the words "Let's Go Surfing" must appear at the |
| 30 | bottom of the plate. |
| 31 | (b) The license plate annual use fees shall be distributed |
| 32 | to East Coast Surfing Hall of Fame and Museum, Inc., to fund |
| 33 | activities, programs, and projects to promote Florida's surfing- |
| 34 | related tourism, preserve Florida's surfing history and |
| 35 | heritage, preserve Florida's surf and shores, and honor |
| 36 | lifeguards who patrol Florida's surf and shores to protect |
| 37 | beach-goers, surfers, and others. East Coast Surfing Hall of |
| 38 | Fame and Museum, Inc., may retain all revenue from the annual |
| 39 | use fees until all startup costs for developing and establishing |
| 40 | the plate have been recovered. Thereafter, up to 10 percent of |
| 41 | the annual use fee revenue may be used for administration, |
| 42 | promotion, and marketing of the plate, including the annual |
| 43 | audit and compliance affidavit costs. |
| 44 | (70) FLORIDA HORSE PARK LICENSE PLATES.-- |
| 45 | (a) The department shall develop a Florida Horse Park |
| 46 | license plate as provided in this section. The plate must bear |
| 47 | the colors and design approved by the department. The word |
| 48 | "Florida" must appear at the top of the plate, and the words |
| 49 | "Discover Florida's Horses" must appear at the bottom of the |
| 50 | plate. |
| 51 | (b) The annual use fees shall be distributed to the |
| 52 | Florida Agriculture Center and Horse Park Authority created by |
| 53 | s. 570.952, which shall retain all proceeds until all startup |
| 54 | costs for developing and establishing the plate have been |
| 55 | recovered. Thereafter, the proceeds shall be used as follows: |
| 56 | 1. A maximum of 5 percent of the proceeds from the annual |
| 57 | use fees may be used for the administration of the Florida Horse |
| 58 | Park license plate program. |
| 59 | 2. A maximum of 5 percent of the proceeds may be used to |
| 60 | promote and market the license plate. |
| 61 | 3. The remaining proceeds shall be used by the authority |
| 62 | to promote the Florida Agriculture Center and Horse Park located |
| 63 | in Marion County; to support continued development of the park, |
| 64 | including the construction of additional educational facilities, |
| 65 | barns, and other structures; to provide improvements to the |
| 66 | existing infrastructure at the park; and to provide for |
| 67 | operational expenses of the Florida Agriculture Center and Horse |
| 68 | Park. |
| 69 | Section 4. This act shall take effect October 1, 2009. |
