A bill to be entitled
2An act relating to community college student fees;
3amending s. 1009.23, F.S.; deleting the requirement that a
4community college board of trustees use a specified
5portion of tuition and fees to support safety and security
6purposes; providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  Subsection (4) of section 1009.23, Florida
11Statutes, is amended to read:
12     1009.23  Community college student fees.--
13     (4)  Each community college board of trustees shall
14establish tuition and out-of-state fees, which may vary no more
15than 10 percent below and 15 percent above the combined total of
16the standard tuition and fees established in subsection (3),
17provided that any amount from 10 to 15 percent above the
18standard tuition and fees established in subsection (3) shall be
19used only to support safety and security purposes. In order to
20assess an additional amount for safety and security purposes, a
21community college board of trustees must provide written
22justification to the State Board of Education based on criteria
23approved by the board of trustees, including, but not limited
24to, criteria such as local crime data and information, and
25strategies for the implementation of local safety plans. Should
26a college decide to increase the tuition and fees, the funds
27raised by increasing the tuition and fees must be expended
28solely for additional safety and security purposes and shall not
29supplant funding expended in the 1998-1999 budget for safety and
30security purposes.
31     Section 2.  This act shall take effect July 1, 2009.
