A bill to be entitled
2An act relating to inmate medical expenses; creating s.
3945.6041, F.S.; providing definitions; providing limits on
4reimbursement for certain inmate medical expenses when
5there is no contract between the Department of Corrections
6or a private correctional facility and the health care
7provider or provider of emergency medical transportation
8services; providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Section 945.6041, Florida Statutes, is created
13to read:
14     945.6041  Inmate medical services.--
15     (1)  As used in this section, the term:
16     (a)  "Emergency medical transportation services" includes,
17but is not limited to, services rendered by ambulances,
18emergency medical services vehicles, and air ambulances as those
19terms are defined in s. 401.23.
20     (b)  "Health care provider" has the same meaning as
21provided in s. 766.105.
22     (2)(a)  If no contract for the provision of inmate medical
23services exists between the department and a health care
24provider or between a private correctional facility, as defined
25in s. 944.710, and a health care provider, compensation for such
26services may not exceed 110 percent of the Medicare allowable
27rate.
28     (b)  Notwithstanding paragraph (a), if no contract for the
29provision of inmate medical services exists between the
30department and a health care provider or between a private
31correctional facility, as defined in s. 944.710, and a health
32care provider that reported to the Agency for Health Care
33Administration, through hospital-audited financial data, a
34negative operating margin for the previous year, compensation
35for such services may not exceed 125 percent of the Medicare
36allowable rate.
37     (3)  If no contract for emergency medical transportation
38services exists between the department and an entity that
39provides emergency medical transportation services or between a
40private correctional facility, as defined in s. 944.710, and an
41entity that provides emergency medical transportation services,
42compensation for such services may not exceed 110 percent of the
43Medicare allowable rate.
44     (4)  This section is not applicable to charges for medical
45services provided at any hospital operated by the department.
46     Section 2.  This act shall take effect July 1, 2009.
