| 7 | Be It Enacted by the Legislature of the State of Florida: |
| 8 |
|
| 9 | Section 1. Subsection (1) of section 25.073, Florida |
| 10 | Statutes, is amended to read: |
| 11 | 25.073 Retired justices or judges assigned to temporary |
| 12 | duty; additional compensation; appropriation.-- |
| 13 | (1) For purposes of this section, the term "retired |
| 14 | justice" or "retired judge" means any former justice or judge |
| 15 | who is not engaged in the practice of law and either: |
| 16 | (a) Has failed to win reelection or be retained after more |
| 17 | than 12 years of service as a justice or judge; or not been |
| 18 | defeated in seeking reelection to, or has not failed to be |
| 19 | retained in seeking retention in, his or her last judicial |
| 20 | office or was not defeated when last seeking election to |
| 21 | judicial office; and |
| 22 | (b) Has served at least one complete term as a justice or |
| 23 | judge and chose not to stand for retention or reelection at the |
| 24 | conclusion of the latest term is not engaged in the practice of |
| 25 | law. |
| 26 | Section 2. This act shall take effect July 1, 2009. |
