| 11 | Be It Enacted by the Legislature of the State of Florida: |
| 12 |
|
| 13 | Section 1. Section 111.076, Florida Statutes, is created |
| 14 | to read: |
| 15 | 111.076 Reporting of immigration status |
| 16 | information.--Notwithstanding any other provision of law, an |
| 17 | agency, as defined in s. 20.03, may not prohibit or in any way |
| 18 | restrict a public employee from doing any of the following with |
| 19 | respect to information regarding the immigration status of any |
| 20 | individual: |
| 21 | (1) Sending such information to, or requesting or |
| 22 | receiving such information from, the United States Department of |
| 23 | Homeland Security; |
| 24 | (2) Maintaining such information; or |
| 25 | (3) Exchanging such information with any other federal, |
| 26 | state, or local governmental entity. |
| 27 | Section 2. Section 125.582, Florida Statutes, is created |
| 28 | to read: |
| 29 | 125.582 Communicating or cooperating with federal |
| 30 | officials concerning immigration.-- |
| 31 | (1) A county government, whether acting through its |
| 32 | governing body or by an initiative, referendum, or any other |
| 33 | process, may not enact any ordinance or policy that limits or |
| 34 | prohibits a law enforcement officer, local official, or local |
| 35 | government employee from communicating or cooperating with |
| 36 | federal officials with regard to the immigration status of any |
| 37 | person within this state. |
| 38 | (2) Notwithstanding any other provision of law, a county |
| 39 | governmental entity or official may not prohibit or in any way |
| 40 | restrict any governmental entity or government official from |
| 41 | sending to, or receiving from, the United States Department of |
| 42 | Homeland Security information regarding the citizenship or |
| 43 | immigration status of any individual. |
| 44 | Section 3. Section 166.04935, Florida Statutes, is created |
| 45 | to read: |
| 46 | 166.04935 Communicating or cooperating with federal |
| 47 | officials concerning immigration.-- |
| 48 | (1) A municipal government, whether acting through its |
| 49 | governing body or by an initiative, referendum, or any other |
| 50 | process, may not enact any ordinance or policy that limits or |
| 51 | prohibits a law enforcement officer, local official, or local |
| 52 | government employee from communicating or cooperating with |
| 53 | federal officials with regard to the immigration status of any |
| 54 | person within this state. |
| 55 | (2) Notwithstanding any other provision of law, a |
| 56 | municipal governmental entity or official may not prohibit or in |
| 57 | any way restrict any governmental entity or government official |
| 58 | from sending to, or receiving from, the United States Department |
| 59 | of Homeland Security information regarding the citizenship or |
| 60 | immigration status of any individual. |
| 61 | Section 4. This act shall take effect July 1, 2009. |
