2An act relating to law enforcement explorers; amending s.
3784.07, F.S.; defining the term "law enforcement
4explorer"; providing for reclassification of certain
5offenses against law enforcement explorers; reenacting s.
6921.0022(3)(d), (f), and (g), F.S., relating to the
7offense severity ranking chart of the Criminal Punishment
8Code, to incorporate the amendments made to s. 784.07,
9F.S., in references thereto; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:
12
13     Section 1.  Subsections (1) and (2) of section 784.07,
14Florida Statutes, are amended to read:
15     784.07  Assault or battery of law enforcement officers,
16firefighters, emergency medical care providers, public transit
17employees or agents, or other specified officers;
18reclassification of offenses; minimum sentences.--
19     (1)  As used in this section, the term:
20     (a)(c)  "Emergency medical care provider" means an
21ambulance driver, emergency medical technician, paramedic,
22registered nurse, physician as defined in s. 401.23, medical
23director as defined in s. 401.23, or any person authorized by an
24emergency medical service licensed under chapter 401 who is
25engaged in the performance of his or her duties. The term
26"emergency medical care provider" also includes physicians,
27employees, agents, or volunteers of hospitals as defined in
28chapter 395, who are employed, under contract, or otherwise
29authorized by a hospital to perform duties directly associated
30with the care and treatment rendered by the hospital's emergency
31department or the security thereof.
32     (b)  "Firefighter" means any person employed by any public
33employer of this state whose duty it is to extinguish fires; to
34protect life or property; or to enforce municipal, county, and
35state fire prevention codes, as well as any law pertaining to
36the prevention and control of fires.
37     (c)  "Law enforcement explorer" means any person who is a
38current member of a law enforcement agency's explorer program
39and who is performing basic law enforcement functions under the
40direction of a sworn officer and wearing a uniform that bears at
41least one patch that clearly identifies the law enforcement
42agency that he or she represents.
43     (d)(a)  "Law enforcement officer" includes a law
44enforcement officer, a correctional officer, a correctional
45probation officer, a part-time law enforcement officer, a part-
46time correctional officer, an auxiliary law enforcement officer,
47and an auxiliary correctional officer, as those terms are
48respectively defined in s. 943.10, and any county probation
49officer; an employee or agent of the Department of Corrections
50who supervises or provides services to inmates; an officer of
51the Parole Commission; a federal law enforcement officer as
52defined in s. 901.1505; and law enforcement personnel of the
53Fish and Wildlife Conservation Commission, the Department of
54Environmental Protection, or the Department of Law Enforcement.
55     (e)(d)  "Public transit employees or agents" means bus
56operators, train operators, revenue collectors, security
57personnel, equipment maintenance personnel, or field
58supervisors, who are employees or agents of a transit agency as
59described in s. 812.015(1)(l).
60     (2)  Whenever any person is charged with knowingly
61committing an assault or battery upon a law enforcement officer,
62a firefighter, an emergency medical care provider, a traffic
63accident investigation officer as described in s. 316.640, a
64nonsworn law enforcement agency employee who is certified as an
65agency inspector, blood alcohol analyst, or a breath test
66operator while such employee is in uniform and engaged in
67processing, testing, evaluating, analyzing, or transporting a
68person who is detained or under arrest for DUI, a law
69enforcement explorer performing duties under the direction of a
70sworn officer, a traffic infraction enforcement officer as
71described in s. 316.640, a parking enforcement specialist as
72defined in s. 316.640, a person licensed as a security officer
73as defined in s. 493.6101 and wearing a uniform that bears at
74least one patch or emblem that is visible at all times that
75clearly identifies the employing agency and that clearly
76identifies the person as a licensed security officer, or a
77security officer employed by the board of trustees of a
78community college, while the officer, firefighter, emergency
79medical care provider, intake officer, traffic accident
80investigation officer, traffic infraction enforcement officer,
81inspector, analyst, operator, a law enforcement explorer,
82parking enforcement specialist, public transit employee or
83agent, or security officer is engaged in the lawful performance
84of his or her duties, the offense for which the person is
85charged shall be reclassified as follows:
86     (a)  In the case of assault, from a misdemeanor of the
87second degree to a misdemeanor of the first degree.
88     (b)  In the case of battery, from a misdemeanor of the
89first degree to a felony of the third degree.
90     (c)  In the case of aggravated assault, from a felony of
91the third degree to a felony of the second degree.
92Notwithstanding any other provision of law, any person convicted
93of aggravated assault upon a law enforcement officer shall be
94sentenced to a minimum term of imprisonment of 3 years.
95     (d)  In the case of aggravated battery, from a felony of
96the second degree to a felony of the first degree.
97Notwithstanding any other provision of law, any person convicted
98of aggravated battery of a law enforcement officer shall be
99sentenced to a minimum term of imprisonment of 5 years.
100     Section 2.  For the purpose of incorporating the amendment
101made by this act to section 784.07, Florida Statutes, in
102references thereto, paragraphs (d), (f), and (g) of subsection
103(3) of section 921.0022, Florida Statutes, are reenacted to
104read:
