2	An act relating to law enforcement explorers; amending s.
3	784.07, F.S.; defining the term "law enforcement
4	explorer"; providing for reclassification of certain
5	offenses against law enforcement explorers; reenacting s.
6	921.0022(3)(d), (f), and (g), F.S., relating to the
7	offense severity ranking chart of the Criminal Punishment
8	Code, to incorporate the amendments made to s. 784.07,
9	F.S., in references thereto; providing an effective date.

11	Be It Enacted by the Legislature of the State of Florida:
12
13	Section 1.  Subsections (1) and (2) of section 784.07,
14	Florida Statutes, are amended to read:
15	784.07  Assault or battery of law enforcement officers,
16	firefighters, emergency medical care providers, public transit
17	employees or agents, or other specified officers;
18	reclassification of offenses; minimum sentences.--
19	(1)  As used in this section, the term:
20	(a)(c)  "Emergency medical care provider" means an
21	ambulance driver, emergency medical technician, paramedic,
22	registered nurse, physician as defined in s. 401.23, medical
23	director as defined in s. 401.23, or any person authorized by an
24	emergency medical service licensed under chapter 401 who is
25	engaged in the performance of his or her duties. The term
26	"emergency medical care provider" also includes physicians,
27	employees, agents, or volunteers of hospitals as defined in
28	chapter 395, who are employed, under contract, or otherwise
29	authorized by a hospital to perform duties directly associated
30	with the care and treatment rendered by the hospital's emergency
31	department or the security thereof.
32	(b)  "Firefighter" means any person employed by any public
33	employer of this state whose duty it is to extinguish fires; to
34	protect life or property; or to enforce municipal, county, and
35	state fire prevention codes, as well as any law pertaining to
36	the prevention and control of fires.
37	(c)  "Law enforcement explorer" means any person who is a
38	current member of a law enforcement agency's explorer program
39	and who is performing basic law enforcement functions under the
40	direction of a sworn officer and wearing a uniform that bears at
41	least one patch that clearly identifies the law enforcement
42	agency that he or she represents.
43	(d)(a)  "Law enforcement officer" includes a law
44	enforcement officer, a correctional officer, a correctional
45	probation officer, a part-time law enforcement officer, a part-
46	time correctional officer, an auxiliary law enforcement officer,
47	and an auxiliary correctional officer, as those terms are
48	respectively defined in s. 943.10, and any county probation
49	officer; an employee or agent of the Department of Corrections
50	who supervises or provides services to inmates; an officer of
51	the Parole Commission; a federal law enforcement officer as
52	defined in s. 901.1505; and law enforcement personnel of the
53	Fish and Wildlife Conservation Commission, the Department of
54	Environmental Protection, or the Department of Law Enforcement.
55	(e)(d)  "Public transit employees or agents" means bus
56	operators, train operators, revenue collectors, security
57	personnel, equipment maintenance personnel, or field
58	supervisors, who are employees or agents of a transit agency as
59	described in s. 812.015(1)(l).
60	(2)  Whenever any person is charged with knowingly
61	committing an assault or battery upon a law enforcement officer,
62	a firefighter, an emergency medical care provider, a traffic
63	accident investigation officer as described in s. 316.640, a
64	nonsworn law enforcement agency employee who is certified as an
65	agency inspector, blood alcohol analyst, or a breath test
66	operator while such employee is in uniform and engaged in
67	processing, testing, evaluating, analyzing, or transporting a
68	person who is detained or under arrest for DUI, a law
69	enforcement explorer performing duties under the direction of a
70	sworn officer, a traffic infraction enforcement officer as
71	described in s. 316.640, a parking enforcement specialist as
72	defined in s. 316.640, a person licensed as a security officer
73	as defined in s. 493.6101 and wearing a uniform that bears at
74	least one patch or emblem that is visible at all times that
75	clearly identifies the employing agency and that clearly
76	identifies the person as a licensed security officer, or a
77	security officer employed by the board of trustees of a
78	community college, while the officer, firefighter, emergency
79	medical care provider, intake officer, traffic accident
80	investigation officer, traffic infraction enforcement officer,
81	inspector, analyst, operator, a law enforcement explorer,
82	parking enforcement specialist, public transit employee or
83	agent, or security officer is engaged in the lawful performance
84	of his or her duties, the offense for which the person is
85	charged shall be reclassified as follows:
86	(a)  In the case of assault, from a misdemeanor of the
87	second degree to a misdemeanor of the first degree.
88	(b)  In the case of battery, from a misdemeanor of the
89	first degree to a felony of the third degree.
90	(c)  In the case of aggravated assault, from a felony of
91	the third degree to a felony of the second degree.
92	Notwithstanding any other provision of law, any person convicted
93	of aggravated assault upon a law enforcement officer shall be
94	sentenced to a minimum term of imprisonment of 3 years.
95	(d)  In the case of aggravated battery, from a felony of
96	the second degree to a felony of the first degree.
97	Notwithstanding any other provision of law, any person convicted
98	of aggravated battery of a law enforcement officer shall be
99	sentenced to a minimum term of imprisonment of 5 years.
100	Section 2.  For the purpose of incorporating the amendment
101	made by this act to section 784.07, Florida Statutes, in
102	references thereto, paragraphs (d), (f), and (g) of subsection
103	(3) of section 921.0022, Florida Statutes, are reenacted to
104	read:
