       Senator Pruitt moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 67 and 68
    4  insert:
    5         Section 5. The Division of Alcoholic Beverages and Tobacco
    6  may license any winery producing or selling less than 250,000
    7  gallons of wine annually for a $250 annual fee if all taxes are
    8  paid, no underage sales or deliveries are made, and such winery
    9  is not owned by another winery producing or selling more than
   10  250,000 gallons of wine annually. The winery must hold the
   11  license to ship wine and all penalties applicable to the
   12  shipping of wine shall apply equally to shipments made from in
   13  state and out-of-state wineries. The division shall adopt rules
   14  by January 1, 2010, to implement this section and establish
   15  applications for the shipping license.

   18         And the title is amended as follows:
   19         Delete line 22
   20  and insert:
   21         authorizing the Division of Alcoholic Beverages and
   22         Tobacco within the Department of Business and
   23         Professional Regulation to license certain in-state
   24         and out-of-state wineries that meet specified
   25         conditions to ship wine; requiring that the division
   26         adopt rules; providing an effective date.
