    1                        A bill to be entitled                      
    2         An act relating to a review under the Open Government
    3         Sunset Review Act; amending s. 106.0706, F.S.,
    4         relating to a public-records exemption for certain
    5         information regarding campaign finance reports;
    6         clarifying provisions; saving the exemption from
    7         repeal under the Open Government Sunset Review Act;
    8         removing provisions providing for repeal of the
    9         exemption; providing an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12         
   13         Section 1. Section 106.0706, Florida Statutes, is amended
   14  to read:
   15         106.0706 Electronic filing of campaign finance reports;
   16  public-records exemption confidentiality of information and
   17  draft reports.—
   18         (1) All user identifications and passwords held by the
   19  Department of State pursuant to s. 106.0705 are confidential and
   20  exempt from s. 119.07(1) and s. 24(a), Art. I of the State
   21  Constitution.
   22         (2)(a)Information entered All records, reports, and files
   23  stored in the electronic filing system pursuant to s. 106.0705
   24  is are exempt from s. 119.07(1) and s. 24(a), Art. I of the
   25  State Constitution.
   26         (b)Information entered in the electronic filing system is
   27  no longer exempt once the report is until such time as the
   28  report has been submitted to the Division of Elections as a
   29  filed report. This section is subject to the Open Government
   30  Sunset Review Act in accordance with s. 119.15 and shall stand
   31  repealed on October 2, 2009, unless reviewed and saved from
   32  repeal through reenactment by the Legislature.
   33         Section 2. This act shall take effect October 1, 2009.
