| 9 | contracts with the agencies to be increased by excess | 
| 10 | federal earnings; authorizing the department to outsource | 
| 11 | certain functions of the agencies; permitting the agencies | 
| 12 | to make specified expenditures; specifying method of | 
| 13 | payment for fixed-price contracts; providing an effective | 
| 14 | date. |

| 16 | Be It Enacted by the Legislature of the State of Florida: | 
| 17 | 
 | 
| 18 | Section 1.  Subsection (12) is added to section 409.1671, | 
| 19 | Florida Statutes, to read: | 
| 20 | 409.1671  Foster care and related services; outsourcing.-- | 
| 21 | (12)  A contract established between the department and a | 
| 22 | community-based agency under this section must be funded by a | 
| 23 | grant of general revenue and applicable federal funding sources. | 
| 24 | Community-based agencies must document federal funds earned, and | 
| 25 | federal funds earned that are not documented must be returned to | 
| 26 | the department. Notwithstanding subsection (8), the amount of | 
| 27 | the annual contract for a community-based agency may be | 
| 28 | increased by excess federal funds earned in accordance with s. | 
| 29 | 216.181(11). The department may outsource programmatic, | 
| 30 | administrative, or fiscal monitoring oversight of community- | 
| 31 | based agencies. Notwithstanding any other provision of law, a | 
| 32 | community-based agency may make expenditures for staff cellular | 
| 33 | telephone allowances, contracts requiring deferred payments and | 
| 34 | maintenance agreements, security deposits for office leases, | 
| 35 | related professional membership dues and professional state | 
| 36 | license fees, costs of food and refreshment, and costs of | 
| 37 | promotional materials. The method of payment for a fixed-price | 
| 38 | contract with a community-based agency shall include provisions | 
| 39 | for a 2-month advance payment at the beginning of each fiscal | 
| 40 | year with equal monthly payments thereafter. | 
| 41 | Section 2.  This act shall take effect July 1, 2009. |
