| 5 | Section 27. Subsection (7) is added to section 206.9825, |
| 6 | Florida Statutes, to read: |
| 7 | 206.9825 Aviation fuel tax.-- |
| 8 | (7)(a) Commercial airlines that purchase aviation fuel |
| 9 | that is delivered and placed into an aircraft while the aircraft |
| 10 | is in the city designated as the state's capital may obtain a |
| 11 | refund of the tax imposed in paragraph (1)(a) if: |
| 12 | 1. The commercial airline has a ticket counter presence in |
| 13 | the state's capital; and |
| 14 | 2. The commercial airline is refueled in connection with a |
| 15 | flight that embarks or disembarks passengers in the state's |
| 16 | capital. |
| 17 | (b) Refunds claimed pursuant to this subsection shall be |
| 18 | governed by the administrative procedures specified in s. |
| 19 | 206.41(5), except for the provisions requiring refund permits. |
| 20 | (c) The implementation of this subsection shall not |
| 21 | adversely affect aviation grants received by the city due to |
| 22 | administration of the aviation fuel tax refund program. |
