    1                        A bill to be entitled                      
    2         An act relating to cemeteries; amending s. 497.260,
    3         F.S.; exempting from provisions governing cemeteries a
    4         columbarium consisting of 5 acres or less and located
    5         on the main campus of a state university; requiring a
    6         university or university direct-support organization
    7         that establishes the columbarium to ensure that it is
    8         constructed, kept, and maintained in a manner
    9         consistent with s. 497.260(2), F.S., and ch. 497,
   10         F.S.; providing an effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Paragraph (i) is added to subsection (1) of
   15  section 497.260, Florida Statutes, to read:
   16         497.260 Cemeteries; exemption; investigation and
   17  mediation.—
   18         (1) The provisions of this chapter relating to cemeteries
   19  and all rules adopted pursuant thereto shall apply to all
   20  cemeteries except for:
   21         (i) A columbarium consisting of 5 acres or less which is
   22  located on the main campus of a state university as defined in
   23  s. 1000.21(6). The university or university direct-support
   24  organization, as defined in s. 1004.28(1), which establishes the
   25  columbarium shall ensure that the columbarium is constructed and
   26  perpetually kept and maintained in a manner consistent with
   27  subsection (2) and the intent of this chapter.
   28         Section 2. This act shall take effect July 1, 2009.
