| 4 | Between lines 205 and 206, insert: |
| 5 | Section 2. Section 23 of chapter 2008-150, Laws of |
| 6 | Florida, shall be repealed upon the date that the Department of |
| 7 | Environmental Protection issues a notice of intent to issue |
| 8 | permits for the construction and operation of a Class I landfill |
| 9 | at the Cedar Trail landfill to Republic Services of Florida |
| 10 | Limited Partnership or upon the date that the City of Bartow |
| 11 | certifies in writing to the department that a settlement |
| 12 | agreement regarding the Cedar Trail landfill has been executed |
| 13 | with Republic Services of Florida Limited Partnership, whichever |
| 14 | occurs later. Notwithstanding any other provision of law, the |
| 15 | department is authorized to review the application of Republic |
| 16 | Services of Florida Limited Partnership for permits to construct |
| 17 | and operate a Class I landfill at the Cedar Trail landfill and |
| 18 | issue a notice of intent to issue or deny such permits based on |
| 19 | the technical merits of the application. |
