    1                        A bill to be entitled                      
    2         An act relating to the Domestic Violence Trust Fund;
    3         amending s. 938.08, F.S.; requiring the court to
    4         impose a surcharge of $301, rather than the formerly
    5         imposed surcharge of $201, for violations of certain
    6         specified provisions of law and for other offenses of
    7         domestic violence; requiring the clerk of court to
    8         deposit the sum of $185, rather than the formerly
    9         required deposit of $85, into the Domestic Violence
   10         Trust Fund; providing an effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Section 938.08, Florida Statutes, is amended to
   15  read:
   16         938.08 Additional cost to fund programs in domestic
   17  violence.—In addition to any sanction imposed for a violation of
   18  s. 784.011, s. 784.021, s. 784.03, s. 784.041, s. 784.045, s.
   19  784.048, s. 784.07, s. 784.08, s. 784.081, s. 784.082, s.
   20  784.083, s. 784.085, s. 794.011, or for any offense of domestic
   21  violence described in s. 741.28, the court shall impose a
   22  surcharge of $301 $201. Payment of the surcharge shall be a
   23  condition of probation, community control, or any other court
   24  ordered supervision. The sum of $185 $85 of the surcharge shall
   25  be deposited into the Domestic Violence Trust Fund established
   26  in s. 741.01. The clerk of the court shall retain $1 of each
   27  surcharge that the clerk of the court collects as a service
   28  charge of the clerk’s office. The remainder of the surcharge
   29  shall be provided to the governing board of the county and must
   30  be used only to defray the costs of incarcerating persons
   31  sentenced under s. 741.283 and provide additional training to
   32  law enforcement personnel in combating domestic violence.
   33         Section 2. This act shall take effect July 1, 2010.
