A bill to be entitled
2An act relating to animal control or cruelty ordinances;
3amending s. 828.27, F.S.; requiring a county or
4municipality enacting an ordinance relating to animal
5control or cruelty to impose a specified surcharge on the
6civil penalty for violations of the ordinance; specifying
7use of the proceeds of the surcharge; providing
8construction; providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Paragraph (b) of subsection (4) of section
13828.27, Florida Statutes, is amended to read:
14     828.27  Local animal control or cruelty ordinances;
15penalty.-
16     (4)
17     (b)  The governing body of a county or municipality
18enacting an ordinance relating to animal control or cruelty
19shall may impose and collect a surcharge of $15 up to $5 upon
20each civil penalty imposed for each violation of the an
21ordinance relating to animal control or cruelty. One dollar of
22the surcharge may be retained by the clerk of the court, $5 of
23the surcharge proceeds from such surcharges shall be used to pay
24the costs of training for animal control officers, and the
25remainder of the surcharge shall be used to subsidize the costs
26of spaying or neutering of dogs and cats whose owners
27voluntarily submit their animals for sterilization. Owners of
28such animals may not be charged more for the spaying or
29neutering than the cost of sterilization less the subsidy paid
30from the surcharge. This paragraph does not require the
31governing body of a county or municipality to enact such an
32ordinance.
33     Section 2.  This act shall take effect July 1, 2010.
