    1                        A bill to be entitled                      
    2         An act relating to school-based AIDS education;
    3         requiring the Department of Education to award grants
    4         to public school districts to implement school-based
    5         AIDS educational activities; providing for the grant
    6         awards to be made from funds appropriated by the
    7         Legislature; specifying requirements for grant
    8         proposals by school districts; requiring that the
    9         department consider specified factors in awarding
   10         grants; requiring each school district that receives a
   11         grant to file an annual report with the department;
   12         providing an effective date.

   14  Be It Enacted by the Legislature of the State of Florida:
   15  
   16         Section 1. School-based AIDS education incentive grants.—
   17         (1) Beginning with the 2010-2011 school year, from funds
   18  appropriated by the Legislature for this purpose, the Department
   19  of Education shall award grants on a competitive basis to public
   20  school districts wishing to implement AIDS education activities
   21  pursuant to this section. The grants shall be awarded annually
   22  by October 1 of each year.
   23         (2) A school district may apply for a school-based AIDS
   24  education incentive grant by submitting a grant proposal to the
   25  department by August 1 of each year on forms prescribed by the
   26  department. In order to be considered for funding, the grant
   27  proposal must include:
   28         (a) A detailed description of the program to be
   29  implemented, including a statement of program objectives,
   30  activities, target population, and number of students to be
   31  served, and an identification of all education programs,
   32  community agencies, private-sector entities, and other personnel
   33  and resources involved in program development and
   34  implementation;
   35         (b) Assurance that parents and guardians will be involved
   36  in the development and implementation of the program;
   37         (c) A detailed program budget; and
   38         (d) Measures for evaluating the effectiveness of the
   39  program, including outcomes.
   40         (3) The department shall consider the following factors in
   41  awarding grants under this section:
   42         (a) The HIV/AIDS, STD, and teenage pregnancy rates within
   43  the geographic area to be served by the program. Those
   44  geographic areas that have high HIV/AIDS, STD, or teenage
   45  pregnancy rates shall have priority for selection.
   46         (b) The qualifications and training of personnel who will
   47  be responsible for program administration and classroom
   48  implementation.
   49         (c) The extent to which the program will be coordinated
   50  with the existing school comprehensive health education program.
   51         (d) The potential effectiveness of the program.
   52         (e) The degree to which the program’s objectives and
   53  activities are consistent with the goals of this section.
   54         (4) The department shall make available to each school
   55  district applying for a school-based AIDS education incentive
   56  grant information concerning all of the criteria used by the
   57  department in selecting the proposals for funding.
   58         (5) Each school district that is awarded a grant under this
   59  section must submit an annual report to the department
   60  documenting the extent to which the program objectives are being
   61  met.
   62         Section 2. This act shall take effect July 1, 2010.
