| 2 | An act relating to Manatee County; amending chapter 30561 |
| 3 | (1955), Laws of Florida, as amended; revising the legal |
| 4 | boundaries of the City of Anna Maria to remove land that |
| 5 | is currently included in the boundaries of the City of |
| 6 | Holmes Beach and to include described submerged lands; |
| 7 | exempting Manatee County from certain regulations of the |
| 8 | City of Anna Maria; revising the boundaries of the City of |
| 9 | Holmes Beach to include unincorporated land owned by the |
| 10 | Department of Transportation; providing an effective date. |

| 12 | Be It Enacted by the Legislature of the State of Florida: |
| 13 |
|
| 14 | Section 1. Section 6 of chapter 30561 (1955), Laws of |
| 15 | Florida, as amended by chapter 2002-384, Laws of Florida, is |
| 16 | amended to read: |
| 17 | ARTICLE I |
| 18 | GENERAL PROVISIONS |
| 19 | Section 6. The boundaries of the area which shall be |
| 20 | included in the territory of the City of Anna Maria Island, also |
| 21 | known as the City of Anna Maria, in Manatee County, Florida, |
| 22 | shall be as follows: |
| 23 |
|
| 24 | All of that land comprising Anna Maria Island embraced |
| 25 | in U.S. Lot I in Section 7; Lots 1, 2, 3, 4, and 5 in |
| 26 | Section 18; and Lot 2 Lots 2, 3 and 4 in Section 17; |
| 27 | all being in Township 34 South, Range 16 East; along |
| 28 | with all that land comprising Anna Maria Island |
| 29 | embraced in Section 12, Township 34 South, Range 15 |
| 30 | East; along with all lands which have either been |
| 31 | artificially added or naturally accreted to these |
| 32 | described lands, and all contiguous submerged lands |
| 33 | described herein, all being within Manatee County, |
| 34 | Florida. |

| 36 | Being more particularly described as follows: |
| 37 |

| 38 | Begin at the Southeasterly corner of U.S. Government |
| 39 | Lot 5, Section 18, Township 34 South, Range 16 East; |
| 40 | thence Westerly along the Southerly line of said |
| 41 | Section 18 to the intersection with the most seaward |
| 42 | mean lower low water line for The Gulf of Mexico; |
| 43 | thence North-Northwesterly along the sinousities of |
| 44 | the said mean lower low waterline to the most |
| 45 | northerly tip of Anna Maria Island; thence North, |
| 46 | perpendicular to the mean lower low waterline, a |
| 47 | distance of 10 feet; thence Easterly and Southeasterly |
| 48 | along a line 10 feet waterward of, and parallel to, |
| 49 | the sinousities of the mean lower low waterline of |
| 50 | Tampa Bay to the intersection with a line 50 feet |
| 51 | Northwesterly of, and parallel to, the center of the |
| 52 | Rod and Reel Pier; thence N.36°13'E., along said |
| 53 | parallel line, a distance of 270 feet more or less; |
| 54 | thence S.53°47'E., a distance of 100 feet; thence |
| 55 | S.36°13'W., a distance of 270 feet more or less to a |
| 56 | point 10 feet waterward from the mean lower low |
| 57 | waterline; thence Southeasterly along said line 10 |
| 58 | feet waterward of, and parallel to, the sinousities of |
| 59 | the mean lower low waterline of Tampa Bay, a distance |
| 60 | of 2450 feet more or less to the intersection with a |
| 61 | line 600 feet Northwesterly of, and parallel to, the |
| 62 | centerline of the City Pier; thence N.36°44'E., along |
| 63 | said parallel line, a distance of 400 feet more or |
| 64 | less; thence S.53°16'E., a distance of 500 feet; |
| 65 | thence N.36°44'E., parallel to and 100 feet from the |
| 66 | centerline of City Pier, a distance of 360 feet; |
| 67 | thence S.53°16'E., 50 feet Northeasterly of the |
| 68 | northeasterly end of said Pier, a distance of 211 |
| 69 | feet; thence S.36°44'W., a distance of 162 feet; |
| 70 | thence N.53°16'W., a distance of 57 feet: thence |
| 71 | S.36°44'W. along a line parallel to and 50 |
| 72 | southeasterly of the centerline of said Pier, a |
| 73 | distance of 530 feet more or less to a point 10 feet |
| 74 | waterward from the mean lower low waterline; thence |
| 75 | Southeasterly along a line 10 feet waterward of, and |
| 76 | parallel to, the sinousities of the mean lower low |
| 77 | waterline of Tampa Bay, and into the to the Mouth of |
| 78 | the inlet to Bimini Bay; thence in southwestery |
| 79 | direction to a point of tangency with a line 30 feet |
| 80 | waterward of the mean lower low water line of the |
| 81 | spoil island located to the southwest of a Galati's |
| 82 | Marina; thence Westerly along said line 30 feet |
| 83 | waterward of, and parallel to, the sinousities of the |
| 84 | mean lower low waterline of Bimini Bay, and the |
| 85 | projection thereof to a line 30 westerly of the said |
| 86 | Marina's docks to a point 30 feet waterward from the |
| 87 | mean lower low waterline of Bimini Bay; thence |
| 88 | Westerly along said line 30 feet waterward of, and |
| 89 | parallel to, the sinousities of the mean lower low |
| 90 | waterline of Bimini Bay, said line shall run outside |
| 91 | of any canal system and shall project across and not |
| 92 | being influenced by the entrances to said canals to |
| 93 | the intersection of the Easterly line of Section 18, |
| 94 | Township 34 South, Range 16 East; thence Southerly |
| 95 | along said Section line a distance of 2600 feet more |
| 96 | or less to the point of beginning. Containing 550 |
| 97 | acres more or less. |
| 98 |

| 99 | Provided, however, that the City shall have the power to change |
| 100 | its boundaries in the manner hereinafter or as otherwise defined |
| 101 | by the laws of the State of Florida. |
| 102 | Section 2. Notwithstanding section 1, Manatee County shall |
| 103 | be exempt from any codes, ordinances, resolutions, rules, and |
| 104 | regulations of the City of Anna Maria relating to construction, |
| 105 | installation, placement, or location of county structures, |
| 106 | signage, markers, navigation aids, and other facilities and |
| 107 | improvements within waters which were previously under the |
| 108 | jurisdiction of Manatee County before the effective date of this |
| 109 | act. |
| 110 | Section 3. Section 2.01 of article II of the Charter of |
| 111 | the City of Holmes Beach is amended to read: |
| 112 | ARTICLE II. CORPORATE LIMITS |
| 113 | Sec. 2.01. Corporate limits description. |
| 114 | The municipal boundaries and included land areas of the City of |
| 115 | Holmes Beach are described as follows: |
| 116 |

| 117 | U.S. Lot 1, Section 16, U.S. Lots 1, 3, 4, Section 17, |
| 118 | U.S. Lot 1, Section 19, U.S. Lots 1, 2, 3, 4, 5, 6, 7, |
| 119 | Section 20, U.S. Lots 1, 2, Section 21, U.S. Lot 1, |
| 120 | Section 29, U.S. Lots 1, 2, 3, together with that |
| 121 | portion of the causeway for State Road 64 lying |
| 122 | immediately East of the eastern boundary of U.S. Lot |
| 123 | 3, bounded on the west by said eastern boundary of |
| 124 | U.S. Lot 3 and bounded on the north, east and south by |
| 125 | the mean high water line of Anna Maria Sound (Sarasota |
| 126 | Pass), Section 28, U.S. Lot 1, Section 33 all in |
| 127 | Township 34 South, Range 16E with a southern boundary |
| 128 | described as follows: Starting at Sarasota Pass |
| 129 | continuing westerly along the entire southern boundary |
| 130 | as shown on the Sunrise Park Plat (page 31, Plat Book |
| 131 | 10, County of Manatee 1957) continuing westerly along |
| 132 | the south line of Lots 20 and 1 of Block 33 of the |
| 133 | Ilexhurst Plat (page 154 Plat Book 1, County of |
| 134 | Manatee, 1911) to Gulf Drive thence northerly along |
| 135 | Gulf Drive approximately 50 ft. thence westerly |
| 136 | approximately 100 ft. along the south line of Lot 19 |
| 137 | Blocxk 34 Ilexhurst Plat thence northerly |
| 138 | approximately 100 ft. along the west line of Lots 19 |
| 139 | and 18, Block 34 Ilexhurst Plat thence westerly to the |
| 140 | Gulf of Mexico. Such property being otherwise |
| 141 | described as beginning at the City Limits of the City |
| 142 | of Anna Maria on the north and continuing easterly and |
| 143 | southerly from said city limits to the above described |
| 144 | southern boundary otherwise described as the northern |
| 145 | boundary of the City of Bradenton Beach. |

| 147 | Provided, however, that the said city shall have power to change |
| 148 | its boundaries in the manner hereinafter or as otherwise by the |
| 149 | laws of the State of Florida provided. |
| 150 | Section 4. The additional property described in section 3 |
| 151 | is owned by the Department of Transportation and a portion is |
| 152 | leased to Manatee County for a public use recreation area. In |
| 153 | the exercise of police powers and jurisdictional authority |
| 154 | within the property added in section 3, the City of Holmes Beach |
| 155 | shall apply the provisions of the Manatee County Comprehensive |
| 156 | Plan, Manatee County Land Development Code, Manatee County Code |
| 157 | of Ordinances, and Manatee County codes, ordinances, |
| 158 | resolutions, rules, and regulations to this property and all |
| 159 | facilities, improvements, operations, and activities located on |
| 160 | or occurring at the property that is leased by Manatee County |
| 161 | from the Department of Transportation or its successor during |
| 162 | the term of any lease agreement and any renewal of such lease |
| 163 | agreement. |
| 164 | Section 5. This act shall take effect upon becoming a law. |
