2 An act relating to the certification of swimming
3 instructors; amending s. 514.072, F.S.; providing that
4 the American Red Cross may certify persons as swimming
5 instructors for people who have developmental
6 disabilities; deleting an obsolete provision;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 514.072, Florida Statutes, is amended to
12 read:
13 514.072 Certification of swimming instructors for people
14 who have developmental disabilities required.—Any person working
15 at a swimming pool who holds himself or herself out as a
16 swimming instructor specializing in training people who have
17 developmental disabilities, as defined in s. 393.063(10), must
18 may be certified by the Dan Marino Foundation, Inc., or the
19 American Red Cross as a swimming instructor for people who have
20 developmental disabilities, in addition to being certified under
21 s. 514.071. The Dan Marino Foundation, Inc., must develop
22 certification requirements and a training curriculum for
23 swimming instructors for people who have developmental
24 disabilities and must submit the certification requirements to
25 the Department of Health for review by January 1, 2007. A person
26 certified under s. 514.071 before July 1, 2007, must meet the
27 additional certification requirements of this section before
28 January 1, 2008. A person certified under s. 514.071 on or after
29 July 1, 2007, must meet the additional certification
30 requirements of this section within 6 months after receiving
31 certification under s. 514.071. A person certified under this
32 section by the American Red Cross must meet the certification
33 requirements and training curriculum established by the Dan
34 Marino Foundation, Inc., and approved by the department.
35 Section 2. This act shall take effect July 1, 2010.
