    1                        A bill to be entitled                      
    2         An act relating to trust funds; re-creating the
    3         Florida Forever Program Trust Fund within the
    4         Department of Community Affairs; reenacting and
    5         amending s. 380.5115, F.S., relating to the Florida
    6         Forever Program Trust Fund; providing for sources of
    7         funds and purposes; providing for the annual
    8         carryforward of funds; providing for future review and
    9         termination or re-creation of the trust fund;
   10         providing a contingent effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. The Florida Forever Program Trust Fund, FLAIR
   15  number 52-2-349, is re-created within the Department of
   16  Community Affairs.
   17         Section 2. Notwithstanding the repeal contained in section
   18  1 of chapter 2000-281, Laws of Florida, and notwithstanding the
   19  exemption from termination contained in section 2 of chapter
   20  2004-235, Laws of Florida, section 380.5115, Florida Statutes,
   21  is reenacted and amended to read:
   22         380.5115 Florida Forever Program Trust Fund of the
   23  Department of Community Affairs.—
   24         (1) There is created a Florida Forever Program Trust Fund
   25  within the Department of Community Affairs to further the
   26  purposes of this part as specified in s. 259.105(3)(c) and (j).
   27  The trust fund shall receive funds pursuant to s. 259.105(3)(c)
   28  and (j).
   29         (2) Notwithstanding the provisions of s. 216.301 and
   30  pursuant to s. 216.351, any balance in the trust fund at the end
   31  of any fiscal year shall remain in the trust fund at the end of
   32  the year and shall be available for carrying out the purposes of
   33  the trust fund.
   34         (3) Pursuant to the provisions of s. 19(f)(2), Art. III of
   35  the State Constitution, the trust fund shall, unless terminated
   36  sooner, be terminated on July 1, 2014 2004. Prior to its
   37  scheduled termination, the trust fund shall be reviewed as
   38  provided in s. 215.3206(1) and (2).
   39         Section 3. This act shall take effect July 1, 2010, but
   40  this act shall not take effect unless it is enacted by a three
   41  fifths vote of the membership of each house of the Legislature.
