A bill to be entitled
2An act relating to tanning facilities; amending s. 381.89,
3F.S.; requiring the tanning operator or proprietor of the
4tanning facility to witness a parent or legal guardian of
5a minor signing a written statement before the minor is
6allowed to use a tanning device; providing requirements
7for the written statement; revising the age at which a
8minor is allowed to use a tanning device; prohibiting a
9minor younger than a certain age from using a tanning
10device at a tanning facility; deleting provisions
11authorizing the use of a tanning device by certain minors
12if accompanied by a parent or legal guardian; providing an
13effective date.

15Be It Enacted by the Legislature of the State of Florida:

17     Section 1.  Subsections (7) and (8) of section 381.89,
18Florida Statutes, are amended to read:
19     381.89  Regulation of tanning facilities.--
20     (7)  A tanning facility may not allow a 16-year-old or 17-
21year-old minor between the ages of 14 and 18 to use a tanning
22device unless it has on file a statement signed by the minor's
23parent or legal guardian and witnessed by the tanning operator
24or proprietor of the tanning facility stating that the parent or
25legal guardian:
26     (a)  Has read and understands the warnings given by the
27tanning facility;,
28     (b)  Consents to the minor's use of a tanning device;, and
29     (c)  Agrees that the minor will use the provided protective
30eyewear; and.
31     (d)  Authorizes a specified number of tanning sessions for
32the minor during a 12-month period.

34A tanning operator or proprietor shall refuse service to a minor
35if the minor's parent or legal guardian has not signed the
36statement as required by this subsection.
37     (8)  A minor younger than 16 years of under the age may not
38use a tanning device at a tanning facility of 14 must be
39accompanied by a parent or legal guardian when using a tanning
40device.
41     Section 2.  This act shall take effect July 1, 2010.
