1 A bill to be entitled
2 An act relating to biomedical and social research;
3 repealing s. 381.0404, F.S., relating to the Center
4 for Health Technologies; repealing s. 381.85, F.S.,
5 relating to the Florida Biomedical and Social Research
6 Act; amending s. 381.855, F.S.; deleting provisions
7 and cross-references to conform; repealing s. 381.912,
8 F.S., relating to the Cervical Cancer Elimination Task
9 Force; repealing ss. 381.92 and 381.921, F.S.,
10 relating to the Florida Cancer Council and the mission
11 and duties of the council; amending s. 381.922, F.S.;
12 providing the goals for the William G. “Bill”
13 Bankhead, Jr., and David Coley Cancer Research Program
14 which were transferred from s. 381.921, F.S.; deleting
15 a cross-reference to conform; providing an effective
16 date.

18 Be It Enacted by the Legislature of the State of Florida:
19
20 Section 1. Section 381.0404, Florida Statutes, is repealed.
21 Section 2. Section 381.85, Florida Statutes, is repealed.
22 Section 3. Paragraph (a) of subsection (5) of section
23 381.855, Florida Statutes, is amended to read:
24 381.855 Florida Center for Universal Research to Eradicate
25 Disease.—
26 (5) There is established within the center an advisory
27 council that shall meet at least annually.
28 (a) The council shall consist of one representative from a
29 Florida not-for-profit institution engaged in basic and clinical
30 biomedical research and education which receives more than $10
31 million in annual grant funding from the National Institutes of
32 Health, to be appointed by the State Surgeon General from a
33 different institution each term, and one representative from and
34 appointed by each of the following entities:
35 1. Enterprise Florida, Inc.
36 2. BioFlorida.
37 3. The Biomedical Research Advisory Council.
38 4. The Florida Medical Foundation.
39 5. Pharmaceutical Research and Manufacturers of America.
40 6. The Florida Cancer Council.
41 6.7. The American Cancer Society, Florida Division, Inc.
42 7.8. The American Heart Association.
43 8.9. The American Lung Association of Florida.
44 9.10. The American Diabetes Association, South Coastal
45 Region.
46 10.11. The Alzheimer’s Association.
47 11.12. The Epilepsy Foundation.
48 12.13. The National Parkinson Foundation.
49 13.14. The Florida Public Health Institute, Inc.
50 14.15. The Florida Research Consortium.
51 Section 4. Section 381.912, Florida Statutes, is repealed.
52 Section 5. Section 381.92, Florida Statutes, is repealed.
53 Section 6. Section 381.921, Florida Statutes, is repealed.
54 Section 7. Subsections (2) and (5) of section 381.922,
55 Florida Statutes, are amended to read:
56 381.922 William G. “Bill” Bankhead, Jr., and David Coley
57 Cancer Research Program.—
58 (2) The program shall provide grants for cancer research to
59 further the search for cures for cancer.
60 (a) Emphasis shall be given to the following goals
61 enumerated in s. 381.921, as those goals support the advancement
62 of such cures:.
63 1. Efforts to significantly expand cancer research capacity
64 in the state by:
65 a. Identifying ways to attract new research talent and
66 attendant national grant-producing researchers to cancer
67 research facilities in this state;
68 b. Implementing a peer-reviewed, competitive process to
69 identify and fund the best proposals to expand cancer research
70 institutes in this state;
71 c. Funding through available resources for those proposals
72 that demonstrate the greatest opportunity to attract federal
73 research grants and private financial support;
74 d. Encouraging the employment of bioinformatics in order to
75 create a cancer informatics infrastructure that enhances
76 information and resource exchange and integration through
77 researchers working in diverse disciplines, to facilitate the
78 full spectrum of cancer investigations;
79 e. Facilitating the technical coordination, business
80 development, and support of intellectual property as it relates
81 to the advancement of cancer research; and
82 f. Aiding in other multidisciplinary research-support
83 activities as they inure to the advancement of cancer research.
84 2. Efforts to improve both research and treatment through
85 greater participation in clinical trials networks by:
86 a. Identifying ways to increase adult enrollment in cancer
87 clinical trials;
88 b. Supporting public and private professional education
89 programs designed to increase the awareness and knowledge about
90 cancer clinical trials;
91 c. Providing tools to cancer patients and community-based
92 oncologists to aid in the identification of cancer clinical
93 trials available in the state; and
94 d. Creating opportunities for the state’s academic cancer
95 centers to collaborate with community-based oncologists in
96 cancer clinical trials networks.
97 3. Efforts to reduce the impact of cancer on disparate
98 groups by:
99 a. Identifying those cancers that disproportionately impact
100 certain demographic groups; and
101 b. Building collaborations designed to reduce health
102 disparities as they relate to cancer.
103 (b) Preference may be given to grant proposals that foster
104 collaborations among institutions, researchers, and community
105 practitioners, as such proposals support the advancement of
106 cures through basic or applied research, including clinical
107 trials involving cancer patients and related networks.
108 (5) Funds appropriated for the William G. “Bill” Bankhead,
109 Jr., and David Coley Cancer Research Program shall be
110 distributed pursuant to this section to provide grants to
111 researchers seeking cures for cancer and cancer-related
112 illnesses, with emphasis given to the goals enumerated in this
113 section s. 381.921. From the total funds appropriated, an amount
114 of up to 10 percent may be used for administrative expenses. In
115 the 2009-2010 fiscal year, 2.5 percent, not to exceed $25
116 million, of the revenue deposited into the Health Care Trust
117 Fund pursuant to s. 215.5602(12)(a) shall be transferred to the
118 Biomedical Research Trust Fund within the Department of Health
119 for the William G. “Bill” Bankhead, Jr., and David Coley Cancer
120 Research Program.
121 Section 8. This act shall take effect July 1, 2010.
