    1                        A bill to be entitled                      
    2         An act relating to the Family Builders Program;
    3         repealing ss. 39.311-39.318, F.S., relating to the
    4         Family Builders Program, to terminate the program;
    5         amending ss. 39.0121 and 39.301, F.S.; deleting
    6         references to conform; providing an effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Sections 39.311, 39.312, 39.313, 39.314, 39.315,
   11  39.316, 39.317, and 39.318, Florida Statutes, are repealed.
   12         Section 2. Subsection (10) of section 39.0121, Florida
   13  Statutes, is amended to read:
   14         39.0121 Specific rulemaking authority.—Pursuant to the
   15  requirements of s. 120.536, the department is specifically
   16  authorized to adopt, amend, and repeal administrative rules
   17  which implement or interpret law or policy, or describe the
   18  procedure and practice requirements necessary to implement this
   19  chapter, including, but not limited to, the following:
   20         (10) The Family Builders Program, the Intensive Crisis
   21  Counseling Program, and any other early intervention programs
   22  and kinship care assistance programs.
   23         Section 3. Paragraph (a) of subsection (15) of section
   24  39.301, Florida Statutes, is amended to read:
   25         39.301 Initiation of protective investigations.—
   26         (15)(a) If the department or its agent determines that a
   27  child requires immediate or long-term protection through:
   28         1. Medical or other health care; or
   29         2. Homemaker care, day care, protective supervision, or
   30  other services to stabilize the home environment, including
   31  intensive family preservation services through the Family
   32  Builders Program or the Intensive Crisis Counseling Program, or
   33  both,
   34  
   35  such services shall first be offered for voluntary acceptance
   36  unless there are high-risk factors that may impact the ability
   37  of the parents or legal custodians to exercise judgment. Such
   38  factors may include the parents’ or legal custodians’ young age
   39  or history of substance abuse or domestic violence.
   40         Section 4. This act shall take effect July 1, 2010.
