1 A bill to be entitled
2 An act relating to the Florida Comprehensive
3 Assessment Test; recognizing the continuing,
4 devastating, and far-reaching effects of the January
5 12, 2010, earthquake in Haiti; providing that scores
6 resulting from the administration of the Florida
7 Comprehensive Assessment Test during the 2009-2010
8 school year may not be considered for purposes of
9 promotion, retention, or graduation in certain schools
10 having a student population of at least 40 percent who
11 are of Haitian descent; requiring that the State Board
12 of Education adopt guidelines by a specified date for
13 determining whether a school qualifies for this
14 exemption; requiring that the Commissioner of
15 Education make such determination and certify his or
16 her findings to the Governor, the Legislature, and
17 other specified entities by a specified date;
18 providing an effective date.

20 Be It Enacted by the Legislature of the State of Florida:

22 Section 1. In recognition of the continuing, devastating,
23 and far-reaching effects of the January 12, 2010, earthquake in
24 Haiti, any school that has a student population of at least 40
25 percent who are of Haitian descent shall administer the Florida
26 Comprehensive Assessment Test, as required in s. 1008.22,
27 Florida Statutes, during the 2009-2010 school year; however, all
28 students are exempt from any adverse impact the scores may have
29 on promotion, retention, or graduation. The State Board of
30 Education shall adopt guidelines by September 1, 2010, for
31 determining which schools qualify for this exemption. Based on
32 the guidelines, the Commissioner of Education shall determine
33 which schools qualify for this exemption and by October 1, 2010,
34 certify his or her findings to the Governor, the President of
35 the Senate, the Speaker of the House of Representatives, the
36 State Board of Education, and the schools qualifying for this
37 exemption.
38 Section 2. This act shall take effect July 1, 2010.
