1 A bill to be entitled
2 An act relating to illegal immigration; creating s.
3 111.076, F.S.; prohibiting restrictions on the
4 reporting of certain immigration status information by
5 public employees; creating ss. 125.582 and 166.04935,
6 F.S.; prohibiting certain local governmental
7 restrictions on communicating or cooperating with
8 federal officials concerning a person’s citizenship or
9 immigration status; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Section 111.076, Florida Statutes, is created to
14 read:
15 111.076 Reporting of immigration status information.
16 Notwithstanding any other provision of law, a person or agency
17 may not prohibit or in any way restrict a public employee from
18 doing any of the following with respect to information regarding
19 the immigration status of any individual:
20 (1) Sending such information to, or requesting or receiving
21 such information from, the United States Department of Homeland
22 Security;
23 (2) Maintaining such information; or
24 (3) Exchanging such information with any other federal,
25 state, or local governmental entity.
26 Section 2. Section 125.582, Florida Statutes, is created to
27 read:
28 125.582 Communicating or cooperating with federal officials
29 concerning immigration.—
30 (1) A county government, whether acting through its
31 governing body or by an initiative, referendum, or any other
32 process, may not enact any ordinance or policy that limits or
33 prohibits a law enforcement officer, local official, or local
34 governmental employee from communicating or cooperating with
35 federal officials with regard to the immigration status of any
36 person within this state.
37 (2) Notwithstanding any other provision of law, a county
38 governmental entity or official may not prohibit or in any way
39 restrict any governmental entity or government official from
40 sending to, or receiving from, the United States Department of
41 Homeland Security information regarding the citizenship or
42 immigration status of any individual.
43 Section 3. Section 166.04935, Florida Statutes, is created
44 to read:
45 166.04935 Communicating or cooperating with federal
46 officials concerning immigration.—
47 (1) A municipal government, whether acting through its
48 governing body or by an initiative, referendum, or any other
49 process, may not enact any ordinance or policy that limits or
50 prohibits a law enforcement officer, local official, or local
51 governmental employee from communicating or cooperating with
52 federal officials with regard to the immigration status of any
53 person within this state.
54 (2) Notwithstanding any other provision of law, a municipal
55 governmental entity or official may not prohibit or in any way
56 restrict any governmental entity or government official from
57 sending to, or receiving from, the United States Department of
58 Homeland Security information regarding the citizenship or
59 immigration status of any individual.
60 Section 4. This act shall take effect July 1, 2010.
