    1                        A bill to be entitled                      
    2         An act relating to public food service establishments;
    3         creating s. 509.234, F.S.; requiring public food
    4         service establishments to serve sugar free substitutes
    5         for certain syrups and fruit preserves and provide
    6         notice to guests of the availability of such sugar
    7         free substitutes; providing requirements for such
    8         notice; providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Section 509.234, Florida Statutes, is created to
   13  read:
   14         509.234 Sugar free substitutes for syrups and fruit
   15  preserves; notice to guests.—A public food service establishment
   16  that serves pancake or waffle syrup or any jelly, jam,
   17  marmalade, or other fruit preserves must:
   18         (1) Serve a sugar free substitute for such syrup or fruit
   19  preserves.
   20         (2) Provide notice to guests of the availability of such
   21  sugar free syrup or fruit preserves. The notice must be included
   22  on the establishment’s food menu and displayed prominently in
   23  any location at the establishment where any foods served with
   24  such syrup or fruit preserves are advertised for sale,
   25  including, but not limited to, the posting of daily specials, an
   26  overhead menu posted at a food service counter, an outdoor menu
   27  posted for guests using a drive-through service window, and any
   28  signage posted at the establishment.
   29         Section 2. This act shall take effect July 1, 2010.
