A bill to be entitled
2An act relating to public education; creating s.
31003.4505, F.S.; prohibiting district school boards,
4administrative personnel, and instructional personnel from
5discouraging or inhibiting student delivery of an
6inspirational message at a noncompulsory high school
7activity; prohibiting district school boards,
8administrative personnel, and instructional personnel from
9taking affirmative action that infringes or waives the
10rights or freedoms afforded by the First Amendment to the
11United States Constitution; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:
14
15     Section 1.  Section 1003.4505, Florida Statutes, is created
16to read:
17     1003.4505  Delivery of inspirational message.-
18     (1)  District school boards, administrative personnel, and
19instructional personnel are prohibited from discouraging or
20inhibiting the delivery of an inspirational message at a
21noncompulsory high school activity, including, but not limited
22to, a student assembly, a sports event, or other noncompulsory
23school-related activity, if the participating students request
24and initiate the delivery of such inspirational message.
25     (2)  District school boards, administrative personnel, and
26instructional personnel are prohibited from taking affirmative
27action, including, but not limited to, the entry into any
28agreement, that infringes or waives the rights or freedoms
29afforded to instructional personnel, school staff, or students
30by the First Amendment to the United States Constitution, in the
31absence of the express written consent of any individual whose
32constitutional rights would be impacted by such infringement or
33waiver.
34     Section 2.  This act shall take effect July 1, 2010.
