    1                        A bill to be entitled                      
    2         An act relating to public transportation operators;
    3         prohibiting railroad engineers or operators of school
    4         buses or other public transportation vehicles from
    5         writing or sending text messages on electronic
    6         communications devices while operating a public
    7         transportation vehicle; providing a penalty; providing
    8         an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. A railroad engineer or operator of a school bus
   13  or other vehicle used for public transportation may not operate
   14  such public transportation vehicle while using an electronic
   15  communications device to write or send text-based
   16  communications, including text messages, instant messages, or
   17  electronic mail. A violation of this section is a noncriminal
   18  traffic infraction, punishable as a moving violation as provided
   19  in chapter 318, Florida Statutes.
   20         Section 2. This act shall take effect July 1, 2010.
