1 A bill to be entitled
2 An act relating to motor vehicle window sunscreening
3 requirements; amending s. 316.29545, F.S.; providing a
4 medical exemption from sunscreening requirements for
5 persons who are afflicted with any autoimmune disease
6 or other medical conditions; requiring the Department
7 of Highway Safety and Motor Vehicles to consult with
8 its medical advisory board to provide guidance with
9 respect to such autoimmune diseases and other medical
10 conditions; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 316.29545, Florida Statutes, is amended
15 to read:
16 316.29545 Window sunscreening exclusions; medical
17 exemption; certain law enforcement vehicles exempt.—
18 (1) The department shall issue medical exemption
19 certificates to persons who are afflicted with Lupus, any
20 autoimmune disease, or other similar medical conditions that
21 which require a limited exposure to light, which certificates
22 shall entitle the person to whom the certificate is issued to
23 have sunscreening material on the windshield, side windows, and
24 windows behind the driver which is in violation of the
25 requirements of ss. 316.2951-316.2957. The department shall
26 consult with the Medical Advisory Board established in s.
27 322.125 to provide guidance with respect to the autoimmune
28 diseases and other medical conditions that shall be included on
29 provide, by rule, for the form of the medical certificate
30 authorized by this section. At a minimum, the medical exemption
31 certificate shall include a vehicle description with the make,
32 model, year, vehicle identification number, medical exemption
33 decal number issued for the vehicle, and the name of the person
34 or persons who are the registered owners of the vehicle. A
35 medical exemption certificate shall be nontransferable and shall
36 become null and void upon the sale or transfer of the vehicle
37 identified on the certificate.
38 (2) The department shall exempt all law enforcement
39 vehicles used in undercover or canine operations from the window
40 sunscreening requirements of ss. 316.2951-316.2957.
41 (3) The department may charge a fee in an amount sufficient
42 to defray the expenses of issuing a medical exemption
43 certificate as described in subsection (1).
44 Section 2. This act shall take effect July 1, 2010.
