2 An act relating to public records; creating s.
3 341.3026, F.S.; providing an exemption from the
4 public-records law for personal identifying
5 information held by a public transit provider for the
6 purpose of facilitating the purchase of prepaid fare
7 cards; providing for future repeal and legislative
8 review of the exemption under the Open Government
9 Sunset Review Act; providing a statement of public
10 necessity; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 341.3026, Florida Statutes, is created
15 to read:
16 341.3026 Public-records exemption.—
17 (1) Personal identifying information held by a public
18 transit provider, as defined in s. 341.031, for the purpose of
19 prepaying transit fares or acquiring a prepaid transit fare card
20 or similar device, is exempt from s. 119.07(1) and s. 24(a),
21 Art. I of the State Constitution.
22 (2) This section is subject to the Open Government Sunset
23 Review Act in accordance with s. 119.15, and shall stand
24 repealed on October 2, 2015, unless reviewed and saved from
25 repeal through reenactment by the Legislature.
26 Section 2. The Legislature finds that it is a public
27 necessity to exempt from public-records requirements personal
28 identifying information held by a public transit provider for
29 the purpose of facilitating the prepayment of transit fares. The
30 exemption puts individuals who prepay transit fares using a
31 prepaid transit fare card on an equal footing with those who pay
32 cash. Allowing individuals to use a prepaid transit fare card is
33 a more efficient and effective system for collecting transit
34 fares, and not only saves individuals time in accessing the
35 transit system in comparison with individuals who pay cash, but
36 also costs significantly less to administer. Finally, the
37 effective and efficient administration of the prepayment option
38 for public transit programs would be hindered without the
39 exemption as individuals would be less inclined to use this
40 payment method if their personal information were made available
41 to the public.
42 Section 3. This act shall take effect July 1, 2010.
