8amending s. 17, ch. 2008-256, Laws of Florida; revising
9the designation of Jose A. Marques Boulevard in Miami-Dade
10County; designating Verna Bell Way in Nassau County;
11directing the Department of Transportation to erect
12suitable markers; designating a portion of S.W. 67th
13Avenue in Miami-Dade County as a state historic road;
14restricting use of public funds for projects related to
15such road; providing for construction; providing an
16effective date.

18Be It Enacted by the Legislature of the State of Florida:
19
20     Section 1.  Andrew J. Capeletti Memorial Ramp designated;
21Department of Transportation to erect suitable markers.-
22     (1)  The ramp that connects northbound Homestead Extension
23of Florida's Turnpike to northbound Interstate 75 in Miami-Dade
24County is designated as "Andrew J. Capeletti Memorial Ramp."
25     (2)  The Department of Transportation is directed to erect
26suitable markers designating Andrew J. Capeletti Memorial Ramp
27as described in subsection (1).
28     Section 2.  Jose Regueiro Avenue designated; Department of
29Transportation to erect suitable markers.-
30     (1)  That portion of W. 20th Avenue in the City of Hialeah
31between W. 44th Place and Okeechobee Road in Miami-Dade County
32is designated as "Jose Regueiro Avenue."
33     (2)  The Department of Transportation is directed to erect
34suitable markers designating Jose Regueiro Avenue as described
35in subsection (1).
36     Section 3.  Manuel Capo Boulevard designated; Department of
37Transportation to erect suitable markers.-
38     (1)  That portion of S.W. 8th Street between S.W. 24th
39Avenue and S.W. 27th Avenue in Miami-Dade County is designated
40as "Manuel Capo Boulevard."
41     (2)  The Department of Transportation is directed to erect
42suitable markers designating Manuel Capo Boulevard as described
43in subsection (1).
44     Section 4.  Lt. Colonel Charles Brown Memorial Highway
45designated; Department of Transportation to erect suitable
46markers.-
47     (1)  That portion of U.S. Highway 1, also known as State
48Road 5, between S.W. 104th Street and S.W. 112th Street in
49Miami-Dade County is designated as "Lt. Colonel Charles Brown
50Memorial Highway."
51     (2)  The Department of Transportation is directed to erect
52suitable markers designating Lt. Colonel Charles Brown Memorial
53Highway as described in subsection (1).
54     Section 5.  Cuban-American Association of Civil Engineers
55Way designated; Department of Transportation to erect suitable
56markers.-
57     (1)  That portion of N.W. 107th Avenue between Flagler
58Street and N.W. 7th Street in Miami-Dade County is designated as
59"Cuban-American Association of Civil Engineers Way."
60     (2)  The Department of Transportation is directed to erect
61suitable markers designating Cuban-American Association of Civil
62Engineers Way as described in subsection (1).
63     Section 6.  Biscayne Park Way designated; Department of
64Transportation to erect suitable markers.-
65     (1)  That portion of N.E. 6th Avenue between N.E. 113th
66Street and N.E. 121st Street in Miami-Dade County is designated
67as "Biscayne Park Way."
68     (2)  The Department of Transportation is directed to erect
69suitable markers designating Biscayne Park Way as described in
70subsection (1).
71     Section 7.  Dr. Oscar Elias Biscet Boulevard designated;
72Department of Transportation to erect suitable markers.-
73     (1)  That portion of Coral Way between S.W. 32nd Avenue and
74S.W. 37th Avenue in Miami-Dade County is designated as "Dr.
75Oscar Elias Biscet Boulevard."
76     (2)  The Department of Transportation is directed to erect
77suitable markers designating Dr. Oscar Elias Biscet Boulevard as
78described in subsection (1).
79     Section 8.  Father Gerard Jean-Juste Street; Department of
80Transportation to erect suitable markers.-
81     (1)  That portion of 54th Street between N.W. 5th Court and
82N.E. 5th Avenue in Little Haiti in Miami-Dade County is
83designated as "Father Gerard Jean-Juste Street."
84     (2)  The Department of Transportation is directed to erect
85suitable markers designating Father Gerard Jean-Juste Street as
86described in subsection (1).
87     Section 9.  Section 17 of chapter 2008-256, Laws of
88Florida, is amended to read:
89     Section 17.  Dr. Jose A. Marques Boulevard designated;
90Department of Transportation to erect suitable markers.-
91     (1)  That portion of 8th Street between S.W. 107th Avenue
92and S.W. 127th 117th Avenue in Miami-Dade County is designated
93as "Dr. Jose A. Marques Boulevard."
94     (2)  The Department of Transportation is directed to erect
95suitable markers designating Dr. Jose A. Marques Boulevard as
96described in subsection (1).
97     Section 10.  Verna Bell Way designated; Department of
98Transportation to erect suitable markers.-
99     (1)  That portion of State Road 200 between Lime Street and
100Beech Street in the City of Fernandina Beach in Nassau County is
101designated as "Verna Bell Way."
102     (2)  The Department of Transportation is directed to erect
103suitable markers designating Verna Bell Way as described in
104subsection (1).
105     Section 11.  That portion of S.W. 67th Avenue, also known
106as Ludlam Road, between Bird Road and S.W. 136th Street in the
107City of South Miami and the Village of Pinecrest in Miami-Dade
108County is designated as a state historic road. No public funds
109shall be expended for any of the following purposes:
110     (1)  To cut or remove any tree having a diameter at its
111thickest part in excess of 6 inches within 35 feet of either
112side of the paved surface of the road or to engage in an
113activity which requires the removal without the replacement of
114such tree.
115     (2)  The alteration of the physical dimensions or location
116of S.W. 67th Avenue, the median strip thereof, or the land
117adjacent thereto, except:
118     (a)  Routine or emergency utilities maintenance activities
119necessitated to maintain the road as a utility corridor.
120     (b)  Modifications or improvements made to provide for
121vehicular ingress and egress of governmental safety vehicles.
122     (c)  Alterations, modifications, or improvements made for
123the purpose of enhancing life safety vehicular use or pedestrian
124use, or both, of S.W. 67th Avenue, as long as such alterations,
125modifications, or improvements are heard in a public hearing and
126subsequently approved by the governing board of the local
127government in which such alterations, modifications, or
128improvements are located.
129     (3)  Nothing in this section shall be construed to prevent
130the ordinary maintenance and repair of the road or structures,
131provided the physical dimensions and location of the road and
132the appearance of any structure are preserved. However, the
133preservation of the road shall take priority over considerations
134of traffic management, and the public safety shall not be
135construed to require alterations in the road when alternative
136means promoting safety, including more restrictive traffic
137regulations, are available.
138     Section 12.  This act shall take effect July 1, 2010.
