    2         An act relating to public health; amending s.
    3         381.0065, F.S.; delaying the implementation date of
    4         provisions requiring the Department of Health to
    5         administer an onsite sewage treatment and disposal
    6         system evaluation program; providing an effective
    7         date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Paragraph (a) of subsection (5) of section
   12  381.0065, Florida Statutes, is amended to read:
   13         381.0065 Onsite sewage treatment and disposal systems;
   14  regulation.—
   15         (5) EVALUATION AND ASSESSMENT.—
   16         (a) Beginning July January 1, 2011, the department shall
   17  administer an onsite sewage treatment and disposal system
   18  evaluation program for the purpose of assessing the fundamental
   19  operational condition of systems and identifying any failures
   20  within the systems. The department shall adopt rules
   21  implementing the program standards, procedures, and
   22  requirements, including, but not limited to, a schedule for a 5
   23  year evaluation cycle, requirements for the pump-out of a system
   24  or repair of a failing system, enforcement procedures for
   25  failure of a system owner to obtain an evaluation of the system,
   26  and failure of a contractor to timely submit evaluation results
   27  to the department and the system owner. The department shall
   28  ensure statewide implementation of the evaluation and assessment
   29  program by January 1, 2016.
   30         Section 2. This act shall take effect upon becoming a law.
