| 2 | An act relating to trust funds; creating the Sustainable |
| 3 | and Renewable Energy Policy Trust Fund within the Florida |
| 4 | Energy Office of the Department of Environmental |
| 5 | Protection; providing for sources of funds and purposes; |
| 6 | providing for annual carryforward of funds; providing for |
| 7 | the future review and termination or re-creation of the |
| 8 | trust fund; providing a contingent effective date. |

| 10 | Be It Enacted by the Legislature of the State of Florida: |
| 11 |
|
| 12 | Section 1. (1) The Sustainable and Renewable Energy |
| 13 | Policy Trust Fund is created within the Florida Energy Office of |
| 14 | the Department of Environmental Protection. The trust fund shall |
| 15 | be administered by the head of the office or his or her |
| 16 | designee. Funds allocated to the trust fund include funds |
| 17 | received from state appropriations, federal and state grants, |
| 18 | and deposits consisting of the monthly systems benefits charge |
| 19 | collected by the electric utilities in the state from every |
| 20 | residential, commercial, and industrial consumer of electric |
| 21 | service for deposit into the trust fund. The funds in the trust |
| 22 | fund shall be used to support the activities of the direct- |
| 23 | support organization of the office relating to sustainable and |
| 24 | renewable energy projects in this state. |
| 25 | (2) Notwithstanding s. 216.301, Florida Statutes, and |
| 26 | pursuant to s. 216.351, Florida Statutes, any balance in the |
| 27 | trust fund at the end of any fiscal year shall remain in the |
| 28 | trust fund and shall be available for carrying out the purposes |
| 29 | of the trust fund. |
| 30 | (3) In accordance with s. 19(f)(2), Article III of the |
| 31 | State Constitution, the trust fund shall, unless terminated |
| 32 | sooner, be terminated on July 1, 2014. Before its scheduled |
| 33 | termination, the trust fund shall be reviewed as provided in s. |
| 34 | 215.3206(1) and (2), Florida Statutes. |
| 35 | Section 2. This act shall take effect on the same date |
| 36 | that House Bill 29C or similar legislation takes effect, if such |
| 37 | legislation is adopted in the same legislative session or an |
| 38 | extension thereof and becomes law. |
