| 4 | Between lines 514 and 515, insert: |
| 5 | Section 24. Subsection (3) and paragraph (b) of subsection |
| 6 | (6) of section 983.13, Florida Statutes, are amended, and |
| 7 | subsection (11) is added to that section, to read: |
| 8 | 893.13 Prohibited acts; penalties.-- |
| 9 | (3) Any person who delivers, without consideration, not |
| 10 | more than 20 grams of cannabis, as defined in this chapter, |
| 11 | commits a misdemeanor of the second first degree, punishable as |
| 12 | provided in s.775.082, and shall be ordered to pay a fine of |
| 13 | $500 in addition to any fine pursuant to or s.775.083. For |
| 14 | purposes of this paragraph, "cannabis" does not include the |
| 15 | resin extracted from the plants of the genus Cannabis or any |
| 16 | compound manufacture, salt, derivative, mixture or preparation |
| 17 | of such resin. The clerk shall remit 50 percent of the fines |
| 18 | imposed under this subsection to the Department of Revenue for |
| 19 | deposit into the General Revenue Fund. It is the intent of the |
| 20 | Legislature that, to the greatest extent appropriate, a person |
| 21 | be issued a notice to appear for violations of this subsection. |

| 23 | (b) If the offense is the possession of mot more the 20 |
| 24 | grams of cannabis, as defined in this chapter, the person |
| 25 | commits a misdemeanor of the second first degree, punishable as |
| 26 | provided in s. 775.082 and shall be ordered to pay a fine of |
| 27 | $500 in addition to any fine imposed pursuant to or s. 775.083. |
| 28 | For the purpose of this e=subsection, "cannabis" does not |
| 29 | include the resin extracted from the plants of the genus |
| 30 | Cannabis, or any compound manufacture, salt, derivative, mixture |
| 31 | or preparation of such resin. The clerk shall remit 50 percent |
| 32 | of the fines imposed under this subsection to the Department of |
| 33 | Revenue for deposit into the General Revenue Fund. It is the |
| 34 | intent of the legislature that, to the greatest extent |
| 35 | appropriate, a person be issued a notice to appear for |
| 36 | violations of this paragraph. |
| 37 | (11) It is the intent of the Legislature that, to the |
| 38 | greatest extent appropriate, a person be issued a notice to |
| 39 | appear for misdemeanor violations of this section. |
