| 5 | Section 124. Subsections (5), (6), and (7) are added to |
| 6 | section 316.0083, Florida Statutes, to read: |
| 7 | 316.0083 Mark Wandall Traffic Safety Program; |
| 8 | administration; report.- |
| 9 | (5) Prior to installing a traffic infraction detector, the |
| 10 | department, a county, or a municipality must request that the |
| 11 | Department of Transportation perform a safety hazard study for |
| 12 | the intersection. The department, a county, or a municipality |
| 13 | shall be responsible for the cost of the study. A traffic |
| 14 | infraction detector may not be installed until the Department of |
| 15 | Transportation has performed the study and determined that the |
| 16 | intersection warrants a traffic infraction detector. |
| 17 | (6) A safety hazard study required under this section |
| 18 | shall evaluate the safety of an intersection within a 6-month |
| 19 | period. A safety hazard exists if, at the end of the study |
| 20 | period, the Department of Transportation identifies a |
| 21 | statistically disproportionate number of motor vehicle crashes |
| 22 | at the intersection, greater than that of similarly situated |
| 23 | intersections in the county or municipality. |
| 24 | (7) Notwithstanding subsection (1), the department, a |
| 25 | county, or a municipality may not use a traffic infraction |
| 26 | detector to enforce a violation of s. 316.075(1)(c)1. when a |
| 27 | driver is making a right turn or when a driver is making a left |
| 28 | turn from a one-way street onto a one-way street. |
