       Senator Sobel moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 3088 - 3110
    4  and insert:
    5         (2)(a) In determining whether to approve the courses
    6  referenced in this section, the department shall consider course
    7  content designed to promote safety, driver awareness, crash
    8  avoidance techniques, the dangers of driving while distracted,
    9  which must specifically include the use of technology while
   10  driving, and other factors or criteria to improve driver
   11  performance from a safety viewpoint.
   12         Section 81. Subsection (1) of section 322.095, Florida
   13  Statutes, is amended to read:
   14         322.095 Traffic law and substance abuse education program
   15  for driver’s license applicants.—
   16  (1) The Department of Highway Safety and Motor Vehicles must
   17  approve traffic law and substance abuse education courses that
   18  must be completed by applicants for a Florida driver’s license.
   19  The curricula for the courses must provide instruction on the
   20  physiological and psychological consequences of the abuse of
   21  alcohol and other drugs, the societal and economic costs of
   22  alcohol and drug abuse, the effects of alcohol and drug abuse on
   23  the driver of a motor vehicle, the dangers of driving while
   24  distracted, which must specifically include the use of
   25  technology while driving, and the laws of this state relating to
   26  the operation of a motor vehicle. All instructors teaching the
   27  courses shall be certified by the department.
