| 1 | A bill to be entitled | 
| 2 | An act relating to Brevard County; authorizing the | 
| 3 | Division of Alcoholic Beverages and Tobacco of the | 
| 4 | Department of Business and Professional Regulation to | 
| 5 | issue an alcoholic beverage license to the Brevard Art | 
| 6 | Museum, Inc., for use within the museum's buildings; | 
| 7 | requiring payment of a license fee; providing for the sale | 
| 8 | of beverages for consumption at the museum; providing for | 
| 9 | transfer of the license; providing an effective date. |

| 11 | Be It Enacted by the Legislature of the State of Florida: | 
| 12 | 
 | 
| 13 | Section 1.  Notwithstanding any other provision of law, the | 
| 14 | Division of Alcoholic Beverages and Tobacco of the Department of | 
| 15 | Business and Professional Regulation is authorized, upon | 
| 16 | application, to issue an alcoholic beverage license in | 
| 17 | accordance with s. 561.17, Florida Statutes, to the Brevard Art | 
| 18 | Museum, Inc., a corporation not for profit (the "corporation") | 
| 19 | located in Brevard County, for use by the corporation within the | 
| 20 | museum's buildings located at 1463 and 1520 Highland Avenue in | 
| 21 | Melbourne. The corporation shall pay a $400 license fee. | 
| 22 | Section 2.  Alcoholic beverages may be sold by the | 
| 23 | corporation for consumption at the Brevard Art Museum. The | 
| 24 | license issued pursuant to this act does not permit the sale of | 
| 25 | alcoholic beverages in sealed containers for consumption outside | 
| 26 | the Brevard Art Museum. | 
| 27 | Section 3.  The corporation may transfer the license from | 
| 28 | time to time to qualified applicants who are authorized by or | 
| 29 | under contract with the corporation to provide food services at | 
| 30 | the Brevard Art Museum. Upon termination of a transferee's | 
| 31 | authorization or contract, the license shall automatically | 
| 32 | revert by operation of law to the corporation. | 
| 33 | Section 4.  This act shall take effect upon becoming a law. |
