4     Amendment (with title amendment)
5     Between lines 2940 and 2941, insert:
6     Section 79.  Subsections (5), (6), and (7) are added to
7section 316.0083, Florida Statutes, to read:
8     316.0083  Mark Wandall Traffic Safety Program;
9administration; report.-
10     (5)  Prior to installing a traffic infraction detector, the
11department, a county, or a municipality must request that the
12Department of Transportation perform a safety hazard study for
13the intersection. The department, a county, or a municipality
14shall be responsible for the cost of the study. A traffic
15infraction detector may not be installed until the Department of
16Transportation has performed the study and determined that the
17intersection warrants a traffic infraction detector.
18     (6)  A safety hazard study required under this section
19shall evaluate the safety of an intersection within a 6-month
20period. A safety hazard exists if, at the end of the study
21period, the Department of Transportation identifies a
22statistically disproportionate number of motor vehicle crashes
23at the intersection, greater than that of similarly situated
24intersections in the county or municipality.
25     (7)  Notwithstanding subsection (1), the department, a
26county, or a municipality may not use a traffic infraction
27detector to enforce a violation of s. 316.075(1)(c)1. when a
28driver is making a right turn or when a driver is making a left
29turn from a one-way street onto a one-way street.

34     Remove line 265 and insert:

36requiring the Department of Highway Safety and Motor Vehicles, a
37municipality, or a county to request that the Department of
38Transportation perform a safety hazard study before installing a
39traffic infraction detector; specifying which entity is
40responsible for the cost of the study; providing that a traffic
41infraction detector may not be installed unless it is determined
42to be warranted; providing requirements for the safety hazard
43study; providing that traffic infraction detectors may not be
44used to issue certain violations; providing effective dates.
