       Senator Sachs moved the following:
       
    1         Senate Amendment to Amendment (404618) (with title
    2  amendment)

    4         Delete lines 2188 - 2302
    5  and insert:
    6         Section 46. Subsections (1), (2), (3), and (6) of section
    7  103.101, Florida Statutes, are amended to read:
    8         103.101 Presidential preference primary.—
    9         (1) Each political party other than a minor political party
   10  shall, on the first last Tuesday in March January in each year
   11  the number of which is a multiple of 4, elect one person to be
   12  the candidate for nomination of such party for President of the
   13  United States or select delegates to the national nominating
   14  convention, as provided by party rule.
   15         (2)(a) There shall be a Presidential Candidate Selection
   16  Committee composed of the Secretary of State, who shall be a
   17  nonvoting chair; the Speaker of the House of Representatives;
   18  the President of the Senate; the minority leader of each house
   19  of the Legislature; and the chair of each political party
   20  required to have a presidential preference primary under this
   21  section.
   22         (b) By December October 31 of the year preceding the
   23  Florida presidential preference primary, each political party
   24  shall submit to the Secretary of State a list of its
   25  presidential candidates to be placed on the presidential
   26  preference primary ballot or candidates entitled to have
   27  delegates appear on the presidential preference primary ballot.
   28  The Secretary of State shall prepare and publish a list of the
   29  names of the presidential candidates submitted. The Secretary of
   30  State shall submit such list of names of presidential candidates
   31  to the selection committee on the first Tuesday after the first
   32  Monday in January each November of the year that a preceding the
   33  presidential preference primary election is held. Each person
   34  designated as a presidential candidate shall have his or her
   35  name appear, or have his or her delegates’ names appear, on the
   36  presidential preference primary ballot unless all committee
   37  members of the same political party as the candidate agree to
   38  delete such candidate’s name from the ballot.
   39         (c) The selection committee shall meet in Tallahassee on
   40  the first Tuesday after the first Monday in January each
   41  November of the year that a preceding the presidential
   42  preference primary is held. The selection committee shall
   43  publicly announce and submit to the Department of State no later
   44  than 5 p.m. on the following day the names of presidential
   45  candidates who shall have their names appear, or who are
   46  entitled to have their delegates’ names appear, on the
   47  presidential preference primary ballot. The Department of State
   48  shall immediately notify each presidential candidate designated
   49  by the committee. Such notification shall be in writing, by
   50  registered mail, with return receipt requested.
   51         (3) A candidate’s name shall be printed on the presidential
   52  preference primary ballot unless the candidate submits to the
   53  Department of State, prior to the second Tuesday after the first
   54  Monday in January November of the year preceding the
   55  presidential preference primary, an affidavit stating that he or
   56  she is not now, and does not presently intend to become, a
   57  candidate for President at the upcoming nominating convention.
   58  If a candidate withdraws pursuant to this subsection, the
   59  Department of State shall notify the state executive committee
   60  that the candidate’s name will not be placed on the ballot. The
   61  Department of State shall, no later than the third Tuesday after
   62  the first Monday in January November of the year preceding the
   63  presidential preference primary, certify to each supervisor of
   64  elections the name of each candidate for political party
   65  nomination to be printed on the ballot.
   66         (6) Delegates must qualify no later than the second Friday
   67  in January November of the year preceding the presidential
   68  preference primary in the manner provided by party rule.
