    1                        A bill to be entitled                      
    2         An act relating to administration of medication for
    3         persons with developmental disabilities; amending s.
    4         393.506, F.S.; requiring a registered nurse or
    5         physician to assess and validate a direct service
    6         provider’s competency in all routes of medication
    7         administration at an onsite setting with an actual
    8         client; providing an exception; providing an effective
    9         date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Subsection (4) of section 393.506, Florida
   14  Statutes, is amended to read:
   15         393.506 Administration of medication.—
   16         (4) A registered nurse licensed under chapter 464 or a
   17  physician licensed under chapter 458 or chapter 459 shall
   18  annually assess and validate a direct service provider’s
   19  competency in all routes of medication administration as
   20  provided in subsection (1), except for the topical, transdermal,
   21  and otic routes, in an onsite setting with an actual client. The
   22  topical, transdermal, and otic routes of medication
   23  administration may be validated by simulation during the
   24  required training course and do not require annual revalidation.
   25  The determination of competency and annual validation required
   26  in this section shall be conducted by a registered nurse
   27  licensed pursuant to chapter 464 or a physician licensed
   28  pursuant to chapter 458 or chapter 459.
   29         Section 2. This act shall take effect July 1, 2011.
