| 3 | creating s. 514.0315, F.S.; requiring public swimming |
| 4 | pools and spas to be equipped with certain safety |
| 5 | features; providing an effective date. |

| 7 | Be It Enacted by the Legislature of the State of Florida: |
| 8 |
|
| 9 | Section 1. Section 514.0315, Florida Statutes, is created |
| 10 | to read: |
| 11 | 514.0315 Required safety features for public swimming |
| 12 | pools and spas.- |
| 13 | (1) A public swimming pool or spa must be equipped with an |
| 14 | anti-entrapment system or device that complies with ASME/ANSI |
| 15 | standard A112.19.8, or any successor standard. |
| 16 | (2) A public swimming pool or spa with a single main drain |
| 17 | other than an unblockable drain must be equipped with at least |
| 18 | one of the following features that complies with any ASME, ANSI, |
| 19 | ASTM, or other applicable consumer product safety standard for |
| 20 | such system or device: |
| 21 | (a) A safety vacuum release system that ceases operation |
| 22 | of the pump, reverses the circulation flow, or otherwise |
| 23 | provides a vacuum release at a suction outlet when a blockage is |
| 24 | detected and that has been tested by an independent third party |
| 25 | and found to conform to ASME/ANSI standard A112.19.17, ASTM |
| 26 | standard F2387, or any successor standard. |
| 27 | (b) A suction-limiting vent system with a tamper-resistant |
| 28 | atmospheric opening. |
| 29 | (c) A gravity drainage system that uses a collector tank. |
| 30 | (d) An automatic pump shut-off system. |
| 31 | (e) A device or system that disables the drain. |
| 32 | (3) The determination and selection of a feature under |
| 33 | subsection (2) is at the sole discretion of the owner or |
| 34 | operator of the public swimming pool or spa. |
| 35 | Section 2. This act shall take effect July 1, 2011. |
