    1                        A bill to be entitled                      
    2         An act relating to school district minimum classroom
    3         expenditure requirements; repealing s. 1011.64, F.S.,
    4         which provides for minimum academic performance
    5         standards and increased classroom expenditure
    6         requirements for school districts not meeting the
    7         standards; amending ss. 1011.01, 1011.03, and 1011.60,
    8         F.S.; conforming provisions to changes made by the
    9         act; providing an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Section 1011.64, Florida Statutes, is repealed.
   14         Section 2. Paragraph (a) of subsection (3) of section
   15  1011.01, Florida Statutes, is amended to read:
   16         1011.01 Budget system established.—
   17         (3)(a) Each district school board and each community
   18  college board of trustees shall prepare, adopt, and submit to
   19  the Commissioner of Education for review an annual operating
   20  budget. Operating budgets shall be prepared and submitted in
   21  accordance with the provisions of law, rules of the State Board
   22  of Education, the General Appropriations Act, and for district
   23  school boards in accordance with s. the provisions of ss.
   24  200.065 and 1011.64.
   25         Section 3. Section 1011.03, Florida Statutes, is amended to
   26  read:
   27         1011.03 Public hearings; budget to be submitted to
   28  Department of Education.—
   29         (1) Each district school board must cause a summary of its
   30  tentative budget, including the proposed millage levies as
   31  provided for by law, to be posted online and advertised one time
   32  in a newspaper of general circulation published in the district
   33  or to be posted at the courthouse if there be no such newspaper.
   34         (2) The advertisement of a district that has been required
   35  by the Legislature to increase classroom expenditures pursuant
   36  to s. 1011.64 must include the following statement:
   37  “This proposed budget reflects an increase in classroom
   38  expenditures as a percent of total current operating
   39  expenditures of XX percent over the (previous fiscal year)
   40  fiscal year. This increase in classroom expenditures is required
   41  by the Legislature because the district has performed below the
   42  required performance standard on XX of XX student performance
   43  standards for the (previous school year) school year. In order
   44  to achieve the legislatively required level of classroom
   45  expenditures as a percentage of total operating expenditures,
   46  the proposed budget includes an increase in overall classroom
   47  expenditures of $XX,XXX,XXX above the amount spent for this same
   48  purpose during the (previous fiscal year) fiscal year. In order
   49  to achieve improved student academic performance, this proposed
   50  increase is being budgeted for the following activities:
   51  ...(list activities and amount budgeted)....”
   52         (3) The advertisement shall appear adjacent to the
   53  advertisement required pursuant to s. 200.065. The State Board
   54  of Education may adopt rules necessary to provide specific
   55  requirements for the format of the advertisement.
   56         Section 4. Subsection (8) of section 1011.60, Florida
   57  Statutes, is amended to read:
   58         1011.60 Minimum requirements of the Florida Education
   59  Finance Program.—Each district which participates in the state
   60  appropriations for the Florida Education Finance Program shall
   61  provide evidence of its effort to maintain an adequate school
   62  program throughout the district and shall meet at least the
   63  following requirements:
   64         (8) MINIMUM CLASSROOM EXPENDITURE REQUIREMENTS.—Comply with
   65  the minimum classroom expenditure requirements and associated
   66  reporting pursuant to s. 1011.64.
   67         Section 5. This act shall take effect July 1, 2011.
