    1                        A bill to be entitled                      
    2         An act relating to dangerous dogs; amending s. 767.11,
    3         F.S.; deleting provisions that includes any dog used
    4         primarily or in part for the purpose of dog fighting
    5         or a dog trained for dog fighting within the
    6         definition of “dangerous dog” for purposes of
    7         provisions regulating dangerous dogs; providing an
    8         effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Subsection (1) of section 767.11, Florida
   13  Statutes, is amended to read:
   14         767.11 Definitions.—As used in this act, unless the context
   15  clearly requires otherwise:
   16         (1) “Dangerous dog” means any dog that according to the
   17  records of the appropriate authority:
   18         (a) Has aggressively bitten, attacked, or endangered or has
   19  inflicted severe injury on a human being on public or private
   20  property;
   21         (b) Has more than once severely injured or killed a
   22  domestic animal while off the owner’s property;
   23         (c) Has been used primarily or in part for the purpose of
   24  dog fighting or is a dog trained for dog fighting; or
   25         (c)(d) Has, when unprovoked, chased or approached a person
   26  upon the streets, sidewalks, or any public grounds in a menacing
   27  fashion or apparent attitude of attack, provided that such
   28  actions are attested to in a sworn statement by one or more
   29  persons and dutifully investigated by the appropriate authority.
   30         Section 2. This act shall take effect July 1, 2011.
