    1                        A bill to be entitled                      
    2         An act relating to driving under the influence;
    3         prohibiting a state or local law enforcement agency
    4         from operating a “no refusal” DUI checkpoint;
    5         providing an effective date.

    7  Be It Enacted by the Legislature of the State of Florida:
    8  
    9         Section 1. Notwithstanding s. 316.1932 or s. 316.1933,
   10  Florida Statutes, or any other provision of law, any state or
   11  local law enforcement agency is prohibited from operating a “no
   12  refusal” DUI checkpoint at which a judge is present on site to
   13  issue a warrant that allows a law enforcement officer to perform
   14  a blood test on a person at the checkpoint without that person’s
   15  consent.
   16         Section 2. This act shall take effect July 1, 2011.
