       Senator Diaz de la Portilla moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Between lines 54 and 55
    4  insert:
    5         Section 5. Subsection (12) of section 163.3167, Florida
    6  Statutes, is amended to read:
    7         163.3167 Scope of act.—
    8         (12) An initiative or referendum process in regard to any
    9  development order or in regard to any local comprehensive plan
   10  amendment or map amendment that affects five or fewer parcels of
   11  land is prohibited. A local government may not adopt any super
   12  majority voting requirement for the adoption of amendments to
   13  the comprehensive plan; however, this prohibition does not apply
   14  to any county that has a population of fewer than 600,000 on
   15  July 1, 2011.

   18         And the title is amended as follows:
   19         After line 7
   20  insert:
   21         made by the act; amending s. 163.3167, F.S.;
   22         prohibiting local governments from requiring a super
   23         majority voting requirement for the adoption of
   24         comprehensive plan amendments; exempting certain
   25         counties from such prohibition; providing an effective
   26         date.
