       The Committee on Budget (Hays) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 5530 and 5531
    4  insert:
    5         Section 70. Subsection (1) of section 483.245, Florida
    6  Statutes, is amended to read:
    7         483.245 Rebates prohibited; penalties.—
    8         (1) It is unlawful for any person to pay or receive any
    9  commission, bonus, kickback, or rebate or engage in any split
   10  fee arrangement in any form whatsoever with any dialysis
   11  facility, physician, surgeon, organization, agency, or person,
   12  either directly or indirectly, for patients referred to a
   13  clinical laboratory licensed under this part. However, it is not
   14  unlawful for a clinical laboratory to provide assistance to any
   15  physician, organization, agency, or person solely for the
   16  purpose of performing duties associated with the collection or
   17  processing of specimens to be sent to a clinical laboratory.

   21         Delete line 342
   22  and insert:
   23         incorporation by reference; amending s. 483.245, F.S.;
   24         clarifying that a clinical laboratory may provide

   26         specimens; amending s. 499.003, F.S.;
