       The Committee on Health Regulation (Garcia) recommended the
       following:
       
    1         Senate Amendment 
    2  
    3         Delete line 3588
    4  and insert:
    5  would pay the noncontracted provider for such services, unless
    6  the agency has developed an average rate for the noncontracted
    7  provider for such services under s. 409.967(3)(c). If the agency
    8  has developed an average rate for the noncontracted provider for
    9  such services under s. 409.967(3)(c), the payment rate for such
   10  services under this paragraph shall be the average rate
   11  developed by the agency for the noncontracted provider for such
   12  services under s. 409.967(3)(c).
