       The Conference Committee on SB 2094 recommended the following:
       
    1         Senate Conference Committee Amendment (with title
    2  amendment)
    3  
    4         Delete everything after the enacting clause
    5  and insert:
    6         Section 1. All collective bargaining issues at impasse for
    7  the 2011-2012 fiscal year between the State of Florida and the
    8  certified representatives of the bargaining units for state
    9  employees shall be resolved as follows:
   10         (1) Collective bargaining issues at impasse between the
   11  State of Florida and the Florida State Fire Service Association
   12  regarding Article 3 “Dues Checkoff,” Article 13 “Health and
   13  Welfare,” and Article 16 “Retirement” shall be resolved pursuant
   14  to the state’s last offer dated February 10, 2011.
   15         (2) Collective bargaining issues at impasse between the
   16  State of Florida and the American Federation of State, County
   17  and Municipal Employees, Florida Council 79, regarding Article 3
   18  “Dues Checkoff,” Article 16 “Payroll Checkoff,” Article 27
   19  “Health Insurance,” and Article 30 “Prevailing Rights” shall be
   20  resolved pursuant to the state’s last offer dated February 10,
   21  2011.
   22         (3) Collective bargaining issues at impasse between the
   23  State of Florida and the Police Benevolent Association – Law
   24  Enforcement Unit regarding Article 3 “Dues Checkoff,” Article 14
   25  “Performance Review,” and Article 27 “Insurance Benefits” shall
   26  be resolved pursuant to the state’s last offer dated February
   27  10, 2011. Article 6 “Grievance Procedure” and Article 24 “On
   28  Call Assignment, Call-Back and Court Appearance” shall be
   29  resolved by maintaining the status quo under the language of the
   30  current collective bargaining agreement.
   31         (4) Collective bargaining issues at impasse between the
   32  State of Florida and the Police Benevolent Association – Special
   33  Agent Unit regarding Article 3 “Dues Checkoff” and Article 27
   34  “Insurance Benefits” shall be resolved pursuant to the state’s
   35  last offer dated February 10, 2011. Article 23 “Workday,
   36  Workweek, and Overtimeand Article 24 “On-Call Assignment,
   37  Call-back and Court Appearance” shall be resolved by maintaining
   38  the status quo under the language of the current collective
   39  bargaining agreement.
   40         (5) Collective bargaining issues at impasse between the
   41  State of Florida and the Federation of Physicians and Dentists –
   42  State Employees Attorneys Guild regarding Article 3 “Dues
   43  Checkoff,” Article 19 “Insurance Benefits,” and Article 22
   44  “Prevailing Rights” shall be resolved pursuant to the state’s
   45  last offer dated February 10, 2011. Article 5 “Employee Rights,
   46  Management, and Union Communications,” Article 7 “Employee
   47  Standards of Conduct and Performance,” Article 11
   48  “Classification Review and Professional Practice Scope,” and
   49  Article 17 “Training and Education” shall be resolved by
   50  maintaining the status quo under the language of the current
   51  collective bargaining agreement.
   52         (6) Collective bargaining issues at impasse between the
   53  State of Florida and the Florida Nurses Association regarding
   54  Article 3 “Dues Checkoff,” Article 23 ”Hours of
   55  Work/Compensatory Time,” Article 27 “Insurance Benefits,” and
   56  Article 31 “Prevailing Rights” shall be resolved pursuant to the
   57  state’s last offer dated February 10, 2011. Article 8 “Work
   58  Force Reduction,” Article 24 “On-Call Assignment,” and Article
   59  26 “Differential Pay” shall be resolved by maintaining the
   60  status quo under the language of the current collective
   61  bargaining agreement.
   62         (7) Collective bargaining issues at impasse between the
   63  State of Florida and the Federation of Physicians and Dentists –
   64  SES Physicians Unit regarding Article 3 “Dues Checkoff,” Article
   65  7 “Employee Standards of Conduct and Performance,” Article 19
   66  “Insurance Benefits,” and Article 22 “Prevailing Rights” shall
   67  be resolved pursuant to the state’s last offer dated February
   68  10, 2011. Article 5 “Employee Rights, Management, and Union
   69  Communications,” Article 6 “Grievance Procedure,” Article 8
   70  “Termination Due to a Reduction in Force and Recall,” Article 16
   71  “Leaves of Absence, Hours of Work,” and Article 17 “Training and
   72  Education” shall be resolved by maintaining the status quo under
   73  the language of the current collective bargaining agreement.
   74         (8) Collective bargaining issues at impasse between the
   75  State of Florida and the Federation of Physicians and Dentists –
   76  SES Supervisory Non-Professional Unit regarding Article 3 “Dues
   77  Checkoff,” Article 23 “Insurance Benefits,” and Article 27
   78  “Prevailing Rights” shall be resolved pursuant to the state’s
   79  last offer dated February 10, 2011. Article 5 “Union Activities
   80  and Employee Representation” and Article 15 “Scope of
   81  Professional Responsibilities” shall be resolved by maintaining
   82  the status quo under the language of the current collective
   83  bargaining agreement.
   84         (9) Collective bargaining issues at impasse between the
   85  State of Florida and the Police Benevolent Association –
   86  Security Services Unit regarding Article 3 “Dues Checkoff,”
   87  Article 14 “Performance Evaluations,” Article 27 “Insurance
   88  Benefits,” and Article 30 “Prevailing Rights” shall be resolved
   89  pursuant to the state’s last offer dated February 10, 2011.
   90  Article 21 “Out of Title Work” shall be resolved pursuant to the
   91  state’s last offer dated March 18, 2011. Article 6 “Grievance
   92  Procedure,” Article 9 “Reassignment, Transfer, Change in Duty
   93  Station,” Article 18 “Leaves of Absence,” Article 23 “Hours of
   94  Work/Overtime,” and Article 24 “On-Call Assignment and Call
   95  Back” shall be resolved by maintaining the status quo under the
   96  language of the current collective bargaining agreement.
   97         (10) Collective bargaining issues at impasse between the
   98  State of Florida and the Police Benevolent Association – Florida
   99  Highway Patrol Unit regarding Article 3 “Dues Checkoff,” Article
  100  16 “Employment Outside State Government,” Article 18 “Hours of
  101  Work, Leave and Job-Connected Disability,” and Article 27
  102  “Insurance Benefits” shall be resolved pursuant to the state’s
  103  last offer dated February 10, 2011. Article 6 “Grievance
  104  Procedure” and Article 24 “On-Call Assignment, Call-Back and
  105  Court Appearance” shall be resolved by maintaining the status
  106  quo under the language of the current collective bargaining
  107  agreement.
  108         (11) Collective bargaining issues at impasse between the
  109  Florida Department of Lottery and the Federation of Public
  110  Employees regarding Article 3 “Dues Checkoff” and Article 17
  111  “Insurance and Benefits” shall be resolved pursuant to the
  112  state’s last offer dated February 14, 2011.

  114  All other mandatory collective bargaining issues at impasse for
  115  the 2011-2012 fiscal year which are not addressed by this act or
  116  the General Appropriations Act for the 2011-2012 fiscal year
  117  shall be resolved consistent with the personnel rules in effect
  118  on May 1, 2011, and by otherwise maintaining the status quo
  119  under the language of the applicable current collective
  120  bargaining agreements.
  121         Section 2. This act shall take effect July 1, 2011.

  128         An act relating to state employees; providing for the
  129         resolution of certain collective bargaining issues at
  130         impasse between the State of Florida and certified
  131         bargaining units of state employees; providing for all
  132         other mandatory collective bargaining issues that are
  133         at impasse and that are not addressed by the act or
  134         the General Appropriations Act to be resolved
  135         consistent with personnel rules or by otherwise
  136         maintaining the status quo; providing an effective
  137         date.
