       The Conference Committee on SB 2128 recommended the following:
       
    1         Senate Conference Committee Amendment (with title
    2  amendment)
    3  
    4         Delete everything after the enacting clause
    5  and insert:
    6         Section 1. Subsection (1) of section 447.205, Florida
    7  Statutes, is amended to read:
    8         447.205 Public Employees Relations Commission.—
    9         (1) The Public Employees Relations Commission, hereinafter
   10  referred to as the “commission,” shall be composed of a chair
   11  and two part-time full-time members to be appointed by the
   12  Governor, subject to confirmation by the Senate, from persons
   13  representative of the public and known for their objective and
   14  independent judgment, who shall not be employed by, or hold any
   15  commission with, any governmental unit in the state or any
   16  employee organization, as defined in this part, while in such
   17  office. In no event shall more than one appointee be a person
   18  who, on account of previous vocation, employment, or
   19  affiliation, is, or has been, classified as a representative of
   20  employers; and in no event shall more than one such appointee be
   21  a person who, on account of previous vocation, employment, or
   22  affiliation, is, or has been, classified as a representative of
   23  employees or employee organizations. The chair of the commission
   24  commissioners shall devote full time to commission duties and
   25  shall not engage in any other business, vocation, or employment
   26  while in such office. The part-time members shall not engage in
   27  any business, vocation, or employment that conflicts with their
   28  duties while in such office. Beginning January 1, 1980, the
   29  chair shall be appointed for a term of 4 years, one commissioner
   30  for a term of 1 year, and one commissioner for a term of 2
   31  years. Thereafter, every term of office shall be for 4 years;
   32  and each term of the office of chair shall commence on January 1
   33  of the second year following each regularly scheduled general
   34  election at which a Governor is elected to a full term of
   35  office. In the event of a vacancy prior to the expiration of a
   36  term of office, an appointment shall be made for the unexpired
   37  term of that office. The chair shall be responsible for the
   38  administrative functions of the commission and shall have the
   39  authority to employ such personnel as may be necessary to carry
   40  out the provisions of this part. Once appointed to the office of
   41  chair, the chair shall serve as chair for the duration of the
   42  term of office of chair. Nothing contained herein prohibits a
   43  chair or commissioner from serving multiple terms.
   44         Section 2. This act shall take effect July 1, 2011.

   51         An act relating to the Public Employees Relations
   52         Commission; amending s. 447.205, F.S.; requiring the
   53         commission to be comprised of a chair and two part
   54         time members; requiring the chair of the commission to
   55         devote full time to commission duties and not engage
   56         in any other business, vocation, or employment while
   57         in such office; prohibiting the part-time members from
   58         engaging in any business, vocation, or employment that
   59         conflicts with their duties while in such office;
   60         providing an effective date.
